Teen party ends in rape charge

MONROE — An alcohol-soaked house party over a year ago has resulted in rape charges involving a teenage victim and a man who was 21 at the time.

According to a criminal complaint, the incident occurred on Oct. 16, 2022, at a house on west Franklin Road in the Town of Monroe.

The then 16-year-old victim and her friends had been drinking and driving around the area that night looking for something to do. At one point, they went to Taco Bell but afterward joined some other friends at the defendant’s home, whom she did not know.

After watching a movie and drinking, some of the party-goers fell asleep. But at about 7 a.m., the victim woke up completely naked and with the defendant allegedly having sex with her. She reported that she was drinking heavily and that it could have happened another time during the night, while everyone was asleep.

According to the criminal complaint, the victim was asked “if this happened one time or more than one time as she had mentioned it happening around sevenish (in the morning). (She) advised it happened twice.”

Her underwear also went missing in the ordeal. The girls eventually called sheriff’s deputies, and the victim was taken to the hospital for evidence collection and later to be interviewed by a domestic abuse specialist. Under state law, an inebriated person cannot give consent for sex and neither can a minor. 

After it was over, several males left the party before the girls went to talk to police and medical officials.

“She advised at one point she watched three guys walk out to the car so she followed them,” the complaint said. “She advised they were all in her car with the lights on and laughing.”

The defendant, Tanner Aebly, 22, was arrested and charged with multiple counts: Two counts of disorderly conduct, a misdemeanor; one count of felony child enticement; felony count of exposing intimate parts; misdemeanor theft; two counts of second-degree sexual assault; two counts of felony third-degree sexual assault; and misdemeanor sexual intercourse with a child.

He is scheduled for an initial appearance on the charges at 1:15 p.m. on Nov. 20 before Green County Circuit Judge Faun M. Phillipson. The defendant’s bond status was not immediately available, according to court records. Also unclear is why it took so long — over a year from the alleged offense — for the case to be brought.

If convicted on just one of the most serious charges, the defendant could face a maximum sentence of up to 40 years in prison, a fine and lifetime registration as a sex offender.
