Complaint vs. Shelton questioned

MONROE - A July 19 hearing was scheduled Friday for a Brodhead man charged in the death of his 2-month-old son.

The hearing will determine the progress of the state's case against Casey J. Shelton, 32.

Shelton also faces charges in connection to injuries sustained by the boy's twin brother.

At a pretrial conference Friday, Green County Circuit Court Judge James Beer scheduled the hearing after Shelton's attorney, Michael Murphy, said he objects to portions of the criminal complaint.

For instance, Murphy said, the complaint alleges Shelton shook Christopher Shelton, while the evidence doesn't necessarily show that. The baby suffered fatal injuries at his home Feb. 28, 2007, near Brodhead.

Green County Assistant District Attorney Jeff Kohl said while there are no witnesses to say Shelton shook the baby, medical reports suggest he was shaken.

"Just like we don't know if he hit the child against a chair or a wall, but we do know there was an impact point," Kohl said, in reference to the action that allegedly led to the baby's death.

Beer told Murphy he should interview the medical examiners who conducted the autopsy. Then Murphy and Kohl will meet with Beer to schedule a hearing to determine what evidence is admissible at Shelton's trial, scheduled to begin Aug. 11.

Murphy also successfully requested a sentence in the criminal complaint be removed. Murphy called "inflammatory" a sentence stating Shelton refused to allow his wife to take the children to the doctor. Kohl told Beer he didn't object to the sentence's removal.

Shelton is charged with first-degree reckless homicide, a class B felony, and two counts of child abuse, one a class G felony and one a class H felony. He faces up to 76 years in prison and up to $35,000 in fines, if convicted.

He was arrested May 14, 2007, in Rock County. He remains jailed on a $100,000 cash bond.

Court records indicate Shelton called 911 on Feb. 28, 2007, and told them he needed an ambulance at his residence in Decatur township because his baby stopped breathing. He told emergency responders he was feeding the baby when the baby began to choke.

Christopher was pronounced dead at Mercy Hospital in Janesville.
