MONROE — A 38-year-old Monticello man is now facing prison time after he allegedly violated terms of his plea related to earlier felony charges that he raped a then-15-year-old girl in his downtown apartment.
Adam Kierna of Monticello now faces prison time — not only on new drug possession charges, but also those related to a deferred prosecution on a charge of second-degree sexual assault of a child. The deferred prosecution was granted in court on Aug. 2. Because of his plea, another third-degree sexual assault charged was dismissed at that time.
“Mr. Kierna was placed on 5 years of probation on Count 3, which was an added count of 3rd Degree Sexual Assault, where he would serve 1 year in the Green County Jail with Huber (work release) Privileges,” said District Attorney Craig Nolen, in an emailed statement. “Additionally, Mr. Kierna was given a Deferred Conviction Agreement on Count 1 (sexual assault), following the entry of Guilty plea to that count, which agreement was to last for a period of five years.”
And then on Dec. 7, 2023, Nolen said, “the State filed a motion to vacate that Deferred Conviction Agreement and proceed to sentencing on Count 1 of 2nd Degree Sexual Assault of Child…”
The new charges are drug related and include felony possession of an illegal article and felony possession of a controlled substance. Nolen did not immediately provide details about the arrest on those charges.
Kierna had an appearance on Dec. 22 before Circuit Judge Thomas J. Vale. According to court records, he had been in Dept. of Corrections custody for violating probation. A Jan. 11, 2024 date has been set for the judge to hear any motions in the case and at press time on Dec. 22, he is listed as being in the Green County Jail.
Officials said the original crime happened around Thanksgiving in 2021 in downtown Monticello, but it did not come to light until later when the victim reported the crime to law enforcement officers nearly 1,000 miles away in Virginia. A statement was taken there on April 6, 2022.
That’s where the victim, now 17, described the incident, in which she visited Kierna at his apartment above a shop in downtown Monticello. The two were playing video games and watching television when the conversation apparently drifted to how pet cats reproduce.
“One thing led to another and I ended up in his bed,” the girl told authorities, according to a criminal complaint.
Later, investigators would get a copy of text messages between the pair, discussing the alleged incident and planning a future rendezvous. At one point in the transcript, the defendant appears to acknowledge what he is doing is wrong in a text to the teen.
“I get it remember to erase these messages first, k,” read one of the man’s texts to the girl, according to the complaint.
Said another of the messages: “When you are 18 do you think we can get married?”
A minor cannot legally consent to sex in Wisconsin. Nolen did not specify an exact sentence the state is seeking at this time, but a conviction on 2nd degree sexual assault of a child carries a maximum 40-year sentence in Wisconsin.
The defendant was arrested on the felony sex charges during a shift of his job at a New Glarus restaurant.
