Woman faces attempted homicide in ax attack

TOWN OF WAYNE - A rural South Wayne woman faces felony charges of attempted homicide and battery following a domestic dispute involving an ax that resulted in life-threatening injuries for a rural South Wayne man.

Brandy Marie Smithey, 32, faces Class A felony charge of first-degree intentional homicide, as well as Class H felonies of aggravated battery and bail jumping following an incident that occurred Feb. 4 in the town of Wayne, according to online court records and a news release from Lafayette County Sheriff's Department.

The investigation revealed that an altercation "involved an edge weapon - an ax in this case" and resulted in life-threatening injuries to Theodore A. Bauer III, 37, Lafayette County Sheriff Reg Gill said. Gill would not elaborate on how the ax was involved in the dispute.

Bauer was treated at Mercy Medical Center in Dubuque, which reported the domestic dispute to Lafayette County detectives Monday. Smithey was arrested the same day.

Gill said the man suffered "significant injuries" in the Feb. 4 incident but could not comment on the man's current condition.

Mercy Medical Center also would not comment on the man's condition Friday evening.

The sheriff's department waited until Friday to release information regarding Smithey's arrest while detectives conducted more interviews, Gill said.

"(Investigation) is still ongoing," Gill said. "We've conducted most of our interviews, but it's still continuing."

Gill would not specify the relationship between the woman and man.

Smithey had an initial appearance Friday in Lafayette Circuit Court where cash bond was set at $100,000 with conditions she have no contact with the alleged victim or his residence in South Wayne. She remains jailed.

A Class A felony charge carries a maximum sentence of life imprisonment.

Smithey has a preliminary hearing on Wednesday in Lafayette County Circuit Court.
