Green County Felonies
• Joshua L. Smiley, 28, Beloit, pleaded no contest May 19 to a Class I felony count of retail theft. The court withheld his sentence but ordered him to serve two years probation. The charge stemmed from a Jan. 20, 2014 incident in which Smiley was arrested and jailed after he fled Walmart loss prevention staff. Police records indicate Smiley owes $622.50 in court costs, $477.97 in restitution and must pay the cost of supervision during his probation term. He also must undergo any treatment or counseling his probation officer deems appropriate.
• Mark J. Dieckman, 30, Monroe, pleaded no contest Monday to a Class F felony count of burglary from a building or dwelling. Judge David Deininger withheld a sentence but ordered Dieckman to serve 21 months probation. The charge stemmed from an April 30, 2014 incident in which Dieckman broke into a locked building in the W5300 block of 6 1/2 Street in Monroe. Surveillance footage showed Dieckman going through several rooms and taking a camera. DNA on a door knob in the building led investigators to Dieckman. Deininger accepted the recommendation to withhold sentencing from District Attorney Gary Luhman, who called Dieckman a "model probationer." Dieckman has maintained steady employment while serving jail time for unrelated charges, Luhman said, and has made progress on his restitution payments. Deininger dismissed but read in a Class A misdemeanor count of theft of movable property related to Dieckman's stealing a camera from the building that his attorney Peter Kind said is valued at $55. The victims of the burglary are seeking a much higher amount in restitution for a new security system, new locks and lost labor costs. Deininger said the court may hold a restitution hearing if the two sides can't strike a deal independently.

• Dwayne P. Helmer, 45, Monroe pleaded no contest Friday to a misdemeanor count of knowingly violating a domestic abuse injunction for sending a threatening text message Nov. 29 to a woman he knows. The message violated an injunction the woman had against Helmer that orders him to avoid communication "likely to cause annoyance or alarm to the victim." Police records indicate Helmer owes $679 in court costs, and the payment plan he requested Friday will be added to his existing payment plan with the court.
