Felonies
A competency hearing was set for Nicholas Alexandre Elmer, 20, New Glarus, at 3 p.m. May 20 in front of Judge James R. Beer. Elmer is charged with a class H felony count of theft of moveable property over $5,000 and under $10,000 and a class I felony count of arson of property other than a building. Elmer's defense attorney, Joseph Pecora, asked for more time for Elmer to receive psychological treatment. District Attorney Gary L. Luhman had no objection as the state is also waiting for testing results on a substance. The charges stem from an incident on McCormick Quarry property in the N4400 block of County J in the Town of Monroe. Reports indicate that between April 23 and May 5, 2014, Elmer took and carried away various items including a 16-foot flatbed tandem axle trailer, a 1995 Chevrolet Silverado truck bed trailer and a Chevrolet front axle, and as a party to a crime, intentionally caused damage to property belonging to John T. McCormick by setting fire to cement forms valued at about $748. If convicted of the class H felony, Elmer could be fined up to $10,000 or imprisoned for more than six years, or both. If convicted of the class I felony, Elmer could be fined up to $10,000 or imprisoned up to nine months, or both.
