‘Not guilty’ plea entered for man in Colony parking lot death

MONROE — A not guilty plea has been entered in circuit court on behalf of Cole D. Syvrud, the Argyle man charged with homicide in the parking-lot death of a Colony Brands employee in Monroe last February.

Authorities said the truck Syvrud was driving was backing up in a parking lot in the 1100 block of 7th Avenue just before 3 p.m. on Friday, Feb. 2 when he struck — while backing up — a 28-year-old woman and Colony employee.

Police initially responded to the incident after receiving a report of “a person … pinned under a vehicle and may not be breathing,” police said in a statement. Despite efforts of first-responders and passersby, Carmen E. Hale, of Monroe, died of her injuries on scene.

The plea was entered on the 27-year-old Syvrud’sbehalf in a hearing Thursday before Circuit Judge Faun M. Phillipson.

The tragic incident occurred along a driveway on the side of the building, according to the criminal complaint. In the complaint, investigators summarized their findings from watching a surveillance video.

According to the criminal complaint, which detailed the video footage, the victim was walking east along a south side of the driveway near the grass median area. It was then observed a white Ford F450 backing up to the east. It is estimated the victim was already about 50 feet away when the truck began backing up, reaching speeds at one point of about 9 MPH.

The distance between impact and the vehicle stopping was estimated at about another 33 feet.

If convicted, Syvrud faces a maximum penalty of up to 10 years in state prison.

Syvrud’s next scheduled court appearance in June 4 in Green County Circuit Court. He has been free on a $5,000 signature bond.
