Two Belmont men get jail for sexual incident with boy

DARLINGTON - Two Belmont men have been convicted in Lafayette County Circuit Court for a three-way sexual incident with a teen.

Johnny M. Brandt, 47, and Cole Andrew Martioski, 23, were involved together in sexual activity with a 16-year-old boy on Dec. 15, 2013, according to court records.

Brandt pleaded guilty April 22 to a Class H felony charge of causing a child to view sexual activity. Felony counts of exposing genitals to a child and exposing a child to harmful material were dismissed but "read in," meaning the judge could consider them in his sentencing.

Brandt also pleaded guilty to a Class G felony charge of third-degree sexual assault stemming from a separate incident with the same boy when the boy was 15 years old.

Brandt was sentenced to six months in jail, with Huber work-release privileges, and three years of probation with the conditions that he have no contact with the victim, comply with all recommended counseling and not drink or go into bars or liquor stores.

Martioski pleaded no contest May 6 to a Class I felony charge of exposing genitals to a child and a Class A misdemeanor charge of having sex with a child age 16 or older.

He was sentenced to three months in jail, with Huber work-release privileges, and three years of probation with the conditions that he comply with all recommended counseling and not drink or go into bars or liquor stores.

According to a police investigation, Martioski attempted to be sodomized by the teen with Brandt present and while pornography videos were playing.

Brandt told police the teen appeared to be drunk and/or high on marijuana at the time. The teen later admitted to police that he was inebriated during the incident.

The teen told police he did not want to press charges against the men because he gave consent. Martioski also said the teen consented to having sexual contact.

State court records show no criminal history for Brandt or Martioski.
