DARLINGTON - A Shullsburg man was sentenced last week to six months in jail followed by three years on probation for felony and misdemeanor convictions in Lafayette County Circuit Court, including stealing a vehicle from an area trucking company.
Kevin M. Niemeyer, 20, pleaded no contest Dec. 21 to felony charges of causing bodily harm or tissue injury to a law enforcement officer, taking and driving a vehicle without consent and possessing narcotic drugs and methamphetamine-related drug paraphernalia. He also pleaded no contest to misdemeanor charges of battery, theft and criminal damage to property.
As part of a plea deal, felony charges of strangulation, burglary, theft and bail jumping and a misdemeanor charge of disorderly conduct were dismissed.
The convictions stem from several incidents over the past year.
On May 26, court records indicate Niemeyer got into an argument over drugs with his father at their home on South Kennedy Street in Shullsburg and broke down a bedroom door when the altercation turned into a physical brawl. After his father hit Niemeyer in the head with a paint can, causing a wound that had to be stapled shut, Niemeyer reportedly chased him with a knife.
The father, 47-year-old Richard A. Niemeyer, Jr., pleaded no contest in October to a felony charge of substantial battery and a misdemeanor charge of disorderly conduct related to the fight and entered a deferred prosecution agreement in the case.
On Oct. 16, Niemeyer's grandmother reported that her house on West Water Street in Shullsburg had been broken into and a personal check and several of her prescribed Fentanyl transdermal patches were missing. An investigating Lafayette County deputy located Niemeyer walking on Wisconsin 11 in Shullsburg and found the missing check from his grandmother on him.
Later, after a search of Niemeyer's residence, officers tried to find Niemeyer but discovered he had left the house on his bicycle in an attempt to go to Dubuque, Iowa. Niemeyer then reportedly ditched the bike and stole a 2015 3500 Ram truck from Heffernan Trucking LLC in Shullsburg.
That same day, Grant County deputies found Niemeyer trying to get the stolen truck out of a ditch. A search turned up the stolen Fentanyl and other drugs and drug paraphernalia in Niemeyer's possession, and he was arrested.
While being booked at the Lafayette County jail, Niemeyer became physically combative with officers, arguing he had paperwork which allowed him to leave. Officers unsuccessfully tried to tase Niemeyer and Niemeyer kicked a deputy in the stomach as he was forcibly placed in a cell, according to court records.
