Shullsburg man facing weapons charges gets another felony charge

DARLINGTON - A Shullsburg man facing felony weapons charges and a charge of pistol-whipping a man in February was charged with another felony Tuesday in connection to a May 21 drunk driving arrest.

David J. Brown, 41, was charged Tuesday in Lafayette County Circuit Court with a Class H felony count of bail jumping and a Class A misdemeanor count of resisting or obstructing an officer. He was also cited for first-offense operating while intoxicated, speeding and failing to keep his vehicle under control.

Brown signed a $5,000 signature bond Tuesday on the new case, with the same conditions as a $5,000 signature bond he signed in February in the weapons case. He is ordered not to drink, go into bars or liquor stores or possess or consume nonprescription controlled substances.

An additional bond condition applied Tuesday stipulates that he not ask anyone to purchase alcohol on his behalf.

Brown appeared in court Wednesday for a status conference in the weapons case. He faces four Class G felony counts of possessing a firearm as a felon. The charges, filed Feb. 23, have a combined maximum sentence of 40 years in prison, $100,000 in fines, or both.

According to police reports, around 2 a.m. Feb. 16, Brown forced his way into the apartment of a woman he knows and aimed a .22-caliber revolver at himself. He pulled the trigger numerous times, but the gun failed to fire. The gun was wrestled away from him, but he allegedly grabbed it and hit another man in the head with the butt of the pistol several times.

Police arrived a short time later and observed a 3-inch-long gash on the victim's forehead. He declined immediate medical attention.

Police reportedly recovered the pistol, as well as a .22 caliber rifle, a .30-06 caliber rifle and a 12-gauge pump shotgun at Brown's residence.

The 1968 Gun Control Act forbids felons from owning guns. Court records indicate Brown was convicted of felony possession of methamphetamine in 2006 in Indiana.

Last week, Brown allegedly violated at least one bond condition in the weapons case. Police pulled him over at 7:35 p.m. May 21 near Veterans Park in Shullsburg, after responding to a report of a car driving over a curb onto the sidewalk. A police report indicates the car smelled of alcohol and Brown failed field sobriety tests.

Brown has a preliminary hearing June 8 in the bail jumping case, and a status conference in the weapons case July 22.
