MONROE - The attorney for a Brodhead man scheduled for a March jury trial in the death of his 2-month-old son stepped down Thursday.
Casey Shelton, 31, Brodhead, was expected to go to trial March 11 but that's been postponed indefinitely until a new attorney can be found.
Frank Medina, Shelton's attorney, requested he be allowed to step down from the case. Medina cited "irreconcilable differences" with Shelton involving the defense and strategies of the case.
"Efforts by this attorney to resolve these differences have been non-productive," he told the court.
He said he and Shelton's attorney-client relationship has ceased to exist and Shelton ignored his legal advice.
"Under these circumstances I cannot provide Mr. Shelton with effective legal representation," Medina told the court.
Medina was appointed to represent Shelton in May.
Shelton faces charges in connection with the death of his 2-month-old baby boy, Christopher, on Feb. 28, and injuries sustained by Christopher's twin brother, Charles. He is charged with first-degree reckless homicide, a class B felony, and two counts of child abuse, one a class G felony and one a class H felony. He faces up to 76 years in prison and up to $35,000 in fines, if convicted.
He was arrested May 14 in Rock County. He remains jailed on a $100,000 cash bond.
Court records indicate Shelton called 9-1-1 on Feb. 28 and said he needed an ambulance at his residence in Decatur township because his baby stopped breathing. He told emergency responders he was feeding the baby when the baby began to choke.
Dr. Robert Corliss, a forensic pathologist from the University of Wisconsin Hospital in Madison, testified at a June 13 hearing that injuries to the skull suffered just before Christopher died were not natural or accidental.
Christopher was pronounced dead at Mercy Hospital in Janesville.
