MONROE - A Brodhead man convicted of killing his 2-month-old son will be sentenced Aug. 24.
It's not soon enough for the baby's mother and grandmother, however.
Casey J. Shelton, 33, was convicted of first-degree reckless homicide Jan. 17 in the death of his son, Christopher, Feb. 28, 2007, at a Decatur township residence. He faces up to 40 years in prison and 20 years extended supervision.
Shelton's attorney, Katherine Findley, was not able to be at the status hearing Friday in Green County Circuit Court due to illness.
In a letter to Green County Circuit Court Judge James Beer, Findley asked that Shelton's sentencing hearing be scheduled after Aug. 20.
"The time is needed for the defense to fully prepare for sentencing," she said.
Beer told Shelton, who appeared in person at the hearing, and Green County Assistant District Attorney Jeff Kohl that he wanted to schedule the sentencing hearing as soon as he could after Aug. 20.
There had been several delays in scheduling a sentencing hearing because Findley hadn't received all of the transcripts from the five-day jury trial. Beer said Findley now has received all transcripts.
Shelton told the judge he was concerned he hasn't seen his attorney except for in court and that he wanted to address some issues with the court.
Beer told Shelton the court would inform Findley that Shelton wanted to see her, but he wasn't going to listen to anything else Shelton had to say.
"I hesitate to let you say anything here without your attorney present," Beer said. "You need to talk to her."
Amy Uptegraw, Christopher's mother, said she was frustrated by another delay in sentencing,
"I want closure," she said. "There needs to be justice for Christopher."
Her mother, Cindy Uptegraw, said she also was frustrated by the fact the sentencing hearing has been delayed.
"I want him sentenced,' she said. "This is taking too long."
Both women were at Friday's hearing at the Green County Courthouse.
A second trial for Shelton has not been scheduled. Shelton is charged with child abuse in connection to injuries sustained by his son, Christopher's twin brother, Charles, in 2007.
In the second case, Shelton is charged with two counts of child abuse, one a class G felony and the other a class H felony. He faces up to 16 years in prison and up to $25,000, if convicted.
Shelton remains jailed. His bond was revoked after the jury found him guilty Jan. 17.
