Man with gun arrested for 6th OWI, police say

MONROE — A Monroe man who reportedly pulled out a gun during a domestic disturbance the afternoon of July 14 was arrested nearby for his sixth offense of drunken driving, according to Monroe police.

Matthew D. Cole, 50, was reported to police after driving off from an altercation involving friends and family at a trailer home in the 500 block of 21st Street at about 4:45 p.m.

Witnesses at the residence told police Cole was carrying a Smith & Wesson .40 pistol.

Police arrested Cole a short time later following a traffic stop in the 1000 block of 19th Street and found the pistol in the vehicle. He underwent field-sobriety tests, then was taken to Monroe Clinic for a mandatory blood draw before being jailed

Cole made his initial appearance Monday in Green County Circuit Court on the sixth-offense charge of operating while intoxicated, a Class G felony that carries a maximum sentence of 10 years in prison and a $25,000 fine. He also faces misdemeanor charges of operating a firearm while intoxicated and domestic abuse-related disorderly conduct involving use of a dangerous weapon.

“I’m not seeing that he brandished” the gun at someone, said Chief of Police Fred Kelley, reviewing his officers’ reports from the scene. But, Kelley added, witnesses did tell officers Cole pulled out the gun and had it in his hands.

Cole’s signature bond was set July 16 at $2,500 with conditions that he not drink or go into bars or liquor stores. He is also ordered not to possess firearms and to turn over any firearms in his possession to his wife. His preliminary hearing is Aug. 16.

State court records show Cole was convicted of fifth-offense OWI in 1998 in Marathon County. Now a felony by state law, the conviction at the time was a misdemeanor. Cole was sentenced to one year in jail for that offense.
