DARLINGTON - A Shullsburg man charged with ongoing sexual assaults of a Shullsburg teen is scheduled to appear in Lafayette County Circuit Court later this month on motions brought by his attorney.
Dean George Ubersox, 52, faces two Class C felony counts of repeated sexual assault of a child, with at least three violations involving first- or second-degree sexual assault. Each charge carries a maximum punishment of 40 years in prison and on parole and fines of up to $100,000.
His attorney, Robert Duxstad, filed motions in April to dismiss one count or combine the two counts into one and to suppress the fruits of a search warrant executed on Ubersox's home last October. A hearing on the motions is set for Oct. 28.
The assaults reportedly spanned a year and a half, beginning in March 2013 and ending in early October 2014, about a month before the charges were filed against Ubersox.
The victim told investigators she sneaked out of the house regularly to meet with Ubersox at his former and current homes and elsewhere and they mutually agreed to have sex on numerous occasions, according to court records. Their sexual relationship started on Facebook, she said. He was looking at her pictures and commented that she was pretty.
Ubersox was living with his elderly father for at least part of the time he was reportedly meeting with the girl. She told investigators she sneaked in without the elder Ubersox knowing.
When Ubersox was arrested, he invoked his right to remain silent and refused to speak with law enforcement about the allegations.
He was released on a $200 cash bond with conditions that he have no contact of any kind with anyone younger than 18.
Court records indicate he has two prior felony convictions in Lafayette County - for a December 1984 armed robbery and for possessing a firearm as a convicted felon in 1992.
