MONROE - Physical evidence obtained during the April 5 robbery of a downtown grocery store is being reviewed by one of the suspect's lawyers, following a status conference on the case Monday.
Luis E. Cruz appeared in custody, represented by his attorney, Ronald Benavides, who appeared on his behalf by telephone.
Cruz is one of two Beloit men arrested following the April 5 incident, which began at El Borrego, a Mexican grocery store on 16th Avenue on the Square. A third suspect, 25-year-old Jonathan E. Guadarrama, was killed after his mini-van rolled near Juda during a high-speed police pursuit.
According to testimony, both Benavides and Green County District Attorney Gary Luhman are reviewing evidence received from the Monroe Police Department last week. Testing of DNA evidence is being done by the Wisconsin Crime Lab.
Charges against Cruz, 30, include: substantial battery with intent to cause bodily harm, a Class I Felony; two counts of armed battery, both Class C felonies; theft of moveable property, a Class I felony; and false imprisonment, a Class H felony.
The court has set pre-trial conference for Cruz on July 5. A status conference for Western is set for May 31.
Western, 35, is charged with substantial battery with intent to cause bodily harm, a Class I Felony; two counts of armed battery, both Class C felonies; and false imprisonment, a Class H felony.
