Smithey gets probation

DARLINGTON - A Browntown woman facing a charge of attempted homicide for attacking her then-boyfriend with an ax was sentenced Wednesday to two years of probation on an unrelated bail jumping charge.

Brandy Smithey, 33, pleaded guilty to a Class H felony charge of bail jumping. The charge arose from a November 2014 incident when she violated her bond from a 2013 OWI charge in Columbia County by consuming intoxicants.

Smithey was sentenced to two years of probation on the bail jumping charge, to be served concurrently with the three years of probation she is currently serving on the OWI charge.

The OWI charge was Smithey's fifth OWI offense. Green County Circuit Judge James Beer warned Smithey that any subsequent OWI convictions would result in a mandatory prison term.

Smithey also faces a Class A felony charge of first-degree intentional homicide, a Class H felony charge of aggravated battery and two additional charges of felony bail jumping. These charges arose from an unrelated incident in February 2015 when she allegedly attacked and severely injured a man with an ax.

Smithey's sentencing date was originally set as May 25 as part of a plea agreement on the homicide charge; a new date has not yet been determined.
