MONROE - A New Glarus man arrested for allegedly attempting to sexually assault a woman was instead charged with disorderly conduct.
Mennen Borucki, 43, was charged with one count of disorderly conduct Monday in Green County Circuit Court. District Attorney Gary Luhman said there is no statute in Wisconsin law that allows for attempted fourth-degree sexual assault, when touching is either intentionally or unintentionally meant to be sexually degrading towards a victim. Since Borucki never allegedly touched the victim in this case he cannot be charged with fourth-degree sexual assault.
Police reports indicate that on Oct. 15, Borucki allegedly attempted to sexually assault a woman at a tavern in New Glarus. The victim reported the incident to police the next day and after reviewing surveillance video allegedly showing Borucki trying to touch the victim inappropriately, he was arrested.
The victim told police Borucki waited for other patrons to leave the bar and made advances at the victim, who fought him off several times before getting up and leaving.
Borucki posted a cash bond on Oct. 20 of $400 and had a $500 signature bond set Monday with additional conditions that he not drink, have any contact with the alleged victim, have no contact with the tavern in New Glarus where the incident occurred, or enter bars or liquor stores except for the winery where Borucki works.
Borucki has an adjourned initial appearance set for Nov. 5.
