MONROE — A Monroe man convicted of felony drug charges — and among those found involved with a former drug house on 9th Street last year — has had his probation revoked by a judge on new charges stemming from a jail-related investigation involving he and his mother.
Leading to the new charges in Green County Circuit Court were recorded conversations between defendant Cody Kirschbaum, 38, and his mother, Kathleen J. Kirschbaum, 57, of Albany, that were reviewed by investigators.
“On 10/23/2025, during my shift, I was notified by Monroe Police Department Officers of narcotic information referencing possible drug activity at the residence of 560 W. 21st St. Lot 58,” said a criminal complaint, citing a jail officer. “Based on the phone conversation I had reason to believe Cody was in possession of narcotics and paraphernalia while under Probation and Parole supervision granting officers justification for an Act 79 Search (of the property).”
Having probable cause from the jail recordings with his mother and other information, investigators were then able to search the residence after which Kirschbaum was additionally charged with felony possession of THC, possession of methamphetamine, and possession of drug paraphernalia.
At one point in the criminal complaint, Kirschbaum responds on the jail phone when his mother asks him why he is asking her to remove a list of items from two boxes at the home: “Bunch of (stuff) I can get in trouble for if someone goes there and looks,” came the reply.
Now those additional charges have placed Cody Kirschbaum on the verge of going to state prison — but not quite, officials say.
“If the probation is revoked in 2025CF169 (the new case) during the next three years, he is not brought back for a sentencing after revocation hearing before the Court … but is instead taken to Dodge Correctional Institution to serve the sentence of 18 months of initial confinement and 18 months of extended supervision (less any time previously spent in connection with that sentence, but that does not include the 12 months he was sentenced to serve in 24CF50),” said District Attorney Craig Nolen, via email Monday.
Meanwhile, Kathleen Kirschbaum has a plea/sentencing hearing set for 10:30 a.m. February 16 in Green County Circuit Court, on related charges of felony harboring/aiding a felon, misdemeanor possession of THC, misdemeanor possession of drug paraphernalia; and misdemeanor encouraging parole/Probation violation.
According to the original criminal complaint, the house on 9th Street was raided by the State Line Anti-Narcotics Team (SLANT) early on March 5, 2024.
Police found eight plants located in a room in the home that had been a former baby nursery, records indicate. Investigators also said in the criminal complaint that they found additional quantities of marijuana, a dozen amphetamine/methamphetamine pills, and several items with apparent cocaine residue.
Police said in the complaint that the evidence is clear in the latest investigation involving her son.
“Based on that statement, I believe Kathleen destroyed whatever narcotic evidence was concealed in the red box she previously secured in order to assist Cody, and thwart Law Enforcement’s efforts from seizing it,” said the complaint
If convicted of the Class felony, Harboring/Aiding a Felon-Falsify Info would expose Kathleen Kirschbaum to a potential, more than three-year state prison sentence.
