MONROE — A Monroe man convicted of his sixth offense of drunken driving was sentenced to one year in jail and five years on probation on Tuesday, May 7.
Matt-hew D. Cole, 50, faces an automatic three years in prison and five years on extended supervision if he breaks the rules of his probation, according to Green County Circuit Court records.
Conditions of his probation include completing anger management counseling and alcohol treatment. He is eligible to serve his jail sentence with Huber work-release privileges as long as he remains alcohol and controlled substance free. His driver’s license is revoked for three years.
He owes $4,101 in court fines and other fees.
Cole pleaded guilty in February to the sixth-offense felony charge of operating while intoxicated. Misdemeanor charges of disorderly conduct, operating a firearm while intoxicated and driving with a prohibited blood-alcohol level were dismissed but “read in,” meaning Judge James Beer could consider them at sentencing.
The case stems from an altercation involving friends and family at a trailer home in the 500 block of 21st Street on the afternoon of July 14.
According to police reports, Cole pulled out a Smith & Wesson .40 pistol during the domestic disturbance, then took off in a vehicle. Police arrested him a short time later during a traffic stop in the 1000 block of 19th Street.
Witnesses told police Cole had the gun in his hands but did not point it at anyone.
State court records show Cole was convicted of fifth-offense OWI in 1998 in Marathon County. Now a felony by state law, the conviction at the time was a misdemeanor and Cole was sentenced to one year in jail. He also has a 2001 Green County misdemeanor conviction of carrying a handgun where alcohol is sold and consumed.
