Monroe man charged with 3rd OWI

MONROE - A Monroe man was charged this week in Green County Circuit Court for a third offense of drunken driving that police suspect may also have involved heroin or another drug.

Jonathan Robert Leverton Duerst, 24, was charged Monday with felony bail jumping as well as misdemeanor counts of third-offense operating while intoxicated, third-offense operating with a prohibited blood-alcohol concentration, operating with a revoked license, failure to install a court-ordered ignition-interlock device and bail jumping.

At his initial appearance Monday, Leverton Duerst signed a $5,000 signature bond with the conditions that he not drive, possess or consume intoxicants or go into bars or liquor stores. A preliminary hearing is set for Jan. 16.

Leverton Duerst was arrested Aug. 3 in the N3500 block of Wisconsin 69, Town of Monroe, after a deputy saw him cross the center line several times, according to court records. The Chevrolet Monte Carlo then swerved into the ditch and down an embankment before coming to a rest.

The deputy noted that Leverton Duerst had slurred, slow speech and bloodshot, glassy eyes and smelled of alcohol. An open tallboy of Busch Light was in the center console.

While the deputy spoke with a nearby property owner who came to investigate the accident, Leverton Duerst nodded off. The deputy returned to find him sleeping with "his head tilted toward the passenger seat."

Once revived, Leverton Duerst was so disoriented he handed the deputy a bag of potato chips when asked for a driver's license.

A breathalyzer test showed his blood-alcohol content was only .052 percent, which is below the legal limit for driving. However, due to his prior OWIs, it qualifies as enough for another OWI charge.

"I was told Leverton Duerst has been taking heroin in the past," the deputy noted in the report. Leverton Duerst's "lack of focus and falling asleep while I was talking with him along with his lack of coordination" indicates he "may have been on some type of drug besides alcohol when he was operating the vehicle."

Court records show OWI convictions for Leverton Duerst from January 2009 and October 2015.

He also currently has an open felony case in Dane County for possession of narcotic drugs and drug paraphernalia, filed in May.
