DARLINGTON - A jury has found a Shullsburg man guilty of causing the death of his girlfriend by driving drunk and crashing her car in August 2011.
The 12-member jury returned their verdict Tuesday, Oct. 8, against Kyle Lee Monahan, 24. His trial began Sept. 30.
Monahan was found guilty on all three charges against him: a Class D felony count of homicide by intoxicated use of a vehicle, a Class D felony count of homicide by driving with a prohibited blood-alcohol level and a Class G felony count of homicide by negligent driving.
His $50,000 signature bond is revoked and he was remanded to the Lafayette County Jail until his sentencing Jan. 23. Judge William D. Johnston is handling the case.
All three convictions are related to the death of 21-year-old Rebecca Lynn Cushman.
According to court records, Monahan was driving Cushman's 2001 Saab station wagon on Dunbarton Road east of Shullsburg at about 8 p.m. on Aug. 20, 2011, when he lost control and the vehicle crashed.
He told an officer on scene he and Cushman had been drinking at the Wheel Inn in Shullsburg, according to a police report. Neither he or Cushman were wearing seatbelts. The car rolled numerous times, ejecting both.
Cushman, a native of Rumford, Maine, was pronounced dead at an area hospital. According to her obituary in the Portland (Maine) Press Herald, she was working as a nanny in Chicago.
Monahan was also seriously injured in the crash and transferred to a Rockford hospital.
State court records indicate Monahan is convicted of driving drunk in June 2010 and January 2011, but has no prior criminal record. For his first offense, a violation of the state's Absolute Sobriety Law, he was fined $389.50. For his second offense, he was fined $867.50 and had his license revoked eight months.
