Man accused of sexual assault pleads not guilty

DARLINGTON - A 22-year-old Belmont man pleaded not guilty to having sexual relations with a teenager and exposing his genitals to a teenager Monday in Lafayette County Circuit Court.

Cole Martioski is charged with a misdemeanor count of having sexual relations with a child aged 16 or older and Class I felony counts of exposing his genitals to a child and exposing harmful material to a child, stemming from an incident that occurred Dec. 15.

Court records indicate Martioski and a co-defendant, Johnny Brandt, 46, Belmont, were involved in sexual activity with a teenaged boy at the victim's request. Martioski alleged the teen consented to having sexual contact and that pornography was playing during the alleged sexual assault.

Police reports allege Martioski attempted to be sodomized by the victim. Brandt told police the victim appeared to be drunk and/or high on marijuana at the time of the alleged assault. The victim told police he did not want to press charges against Martioski or Brandt because he gave consent. The victim admitted to police that he was inebriated during the assault.

Brandt is charged with one Class H felony count of causing a minor to view sexual activity and two Class I felonies, one for exposing his genitals to a minor and for exposing a child to harmful material.

Martioski has a status conference set for Jan. 21. Brandt is due in court for a pretrial conference Nov. 25.
