MONROE - A Middleton man was sentenced last week to 12 months in jail and three years of probation for his fifth offense of driving while intoxicated, according to a criminal complaint filed in Green County Court.

Merrill Cottington, 48, had a blood-alcohol concentration of .084 when he was stopped for speeding on Jan. 23 as he drove northbound on Wisconsin 69 south of County FF. He was charged with operating while intoxicated and operating with a prohibited alcohol concentration, both Class H felony offenses, but the second charge was dismissed in September.

Cottington must serve 12 months in jail, in either Green or Dane County. If he violates his three-year probation period, the court has ordered that he be sent to prison for the remainder of the sentence, up to two years.
