Felonies

On Thursday:

• William R. McGough, 65, Albany, had one count of possessing a firearm contrary to a court order dismissed on a prosecutor's motion. The charge stems from an incident that occurred on March 28. McGough owes no fines or penalties as the charges were dropped.

• Austin D. Flood, 19, Albany, was found guilty due to a not-guilty plea of resisting an officer and had counts of possession of a controlled substance, resisting an officer, criminal damage to property, spitting on an officer and two counts of bail jumping dismissed. Flood will serve two years of probation, and if he complies with all stipulations of probation, the charges could be expunged from his record. Court records indicate that on Aug. 24, Flood's mother called police requesting that they check up on her son, who she said appeared high on pain killers. The responding officer found Flood staggering along North Water Street and approached him. The responding officer searched Flood's person and found a bag filled with about 15 yellow pills identified as Vicodin and several other pills identified as Oxycodone, both proscribed pain killers. As the officer was handling the bag of pills Flood grabbed the bag and attempted to run away, but the officer grabbed Flood's arm before Flood could run away. The officer attempted to subdue Flood, who was resisting arrest. The officer repeatedly told Flood to stop resisting, according to court records. A second officer arrived, but attempts to subdue Flood were unsuccessful. Flood was on the ground, his hands under his stomach and he attempted to spit at an officer's face, the fluid landing on the officer's shirt. The second officer attempted to spray Flood in the face with pepper spray, but it had little effect. The officers called for assistance. Flood was screaming at the officers that he was facing "police brutality." A third officer arrived and attempted to taze Flood with a stun gun, which he used five times before Flood became compliant. Flood was taken to the hospital and had a preliminary blood-alcohol concentration of .17 percent as well as the presence of cocaine, opiates and marijuana in his blood. Flood owes a fine of $176.

• Austin D. Flood, 19, Albany, was found guilty due to a no-contest plea of possession of an illegally obtained prescription. Flood will serve two years of probation concurrent to any other convictions. The charges stem from an incident that occurred on Sept. 22. Flood owes the court $176.

• Benjamin Lamunion, 29, Monroe, was found guilty due to a no-contest plea Tuesday of manufacturing/delivering cocaine and had one count of delivering cocaine and possession of drug paraphernalia dismissed. Lamunion will serve 22 months in state prison and 26 months of probation. Court records indicate that on May 3, Lamunion sold cocaine to an undercover Stateline Area Narcotics Team agent. He owes the court $256.



Misdemeanors

On Thursday:

• Norman W. Mueller, 73, Monroe, was found guilty due to a no-contest plea of disorderly conduct. Mueller paid a forfeiture fine of $267.50. Court records indicate that on Sept. 25, Mueller was arguing with his wife about damage to a vehicle he owns. Mueller then slapped the victim across the back of her head. Mueller told police he hit the victim, but did so because she threw a frozen pizza he was cooking into the kitchen sink.

• Austin D. Flood, 19, Albany, was found guilty due to a no-contest plea of bail jumping. Flood is ordered to serve two years on probation concurrent to any other convictions. He is also ordered to undergo alcohol and other drugs assessment classes, mental health assessment and is ordered not to drink or do drugs. The charges stem from an incident that occurred on May 6.
