Man gets prison for 13th OWI

MONROE — A man arrested for a 13th OWI following a one car accident in October of 2022 has been sentenced to a maximum sentence of about seven years in prison. 

The sentence was handed down on Wednesday, July 26, by Judge Duane Jorgenson in Lafayette County Circuit Court. 

Peter J. Fagan was charged with his 12th operating while intoxicating charge, following the one-car crash in Shullsburg Township, after which the driver and now defendant was flown to the hospital by medical helicopter.

The prison term will be followed by an additional five years of probation, according to court records. Those records show his attorney had requested a term of no longer than six years for the crime.

According to police reports, deputies responded to Wis. 11, in Shullsburg Township for a one-vehicle rollover just before 1:20 a.m. Fagan, 49 at the time, was traveling on the highway when he apparently lost control of his vehicle, “causing the vehicle to exit the roadway, enter a ditch and roll over several times,” reports said.

Fagan’s 2002 Ford was severely damaged and was towed from the scene of the crash, according to police.

The victim was initially transported by Shullsburg EMS crews to Lafayette County Memorial Hospital; and later taken by helicopter to UW Madison for injuries characterized by officials as life-threatening. 

Shullsburg EMS, Shullsburg Fire and UW Madison Med Flight assisted in the response. Fagan’s condition was not immediately available.

Fagan, who was cited for Failure to Maintain Control and Operating while Intoxicated, his 13th such offense. Fagan was last charged with OWI in Lafayette County in 2012, his fourth such arrest. A fourth OWI is considered an automatic felony charge in the state.
