Man facing 13th OWI charge back in court

DARLINGTON -- A Lafayette County man is scheduled to be arraigned Feb. 14 on a new charge of driving while intoxicated, having been arrested for the crime more than 12 times, according to court records.

Peter J. Fagan, 49, of Ontario was arrested for a tentative 12th-offense drunk driving charge after injuring himself in a crash last October, according to court records. Then after that, records show, he logged another tentative OWI case in December but that was rolled into the previous felony 12th OWI case.

Fagan’s most recent court date on the charges was Monday. He is set for arraignment before Lafayette Circuit Judge Duane Jorgenson. 

In the October crash incident, according to the Lafayette County sheriff’s office, Fagan was driving on Wisconsin 11 around 1:20 a.m. when he lost control of his vehicle, went off the road into a ditch; and rolled several times. He was transported by Shullsburg EMS to Memorial Hospital of Lafayette County and then by medical helicopter to UW Hospital in Madison with life-threatening injuries. 

Fagan was also cited for failure to maintain control of a vehicle. 

He was sentenced to four years in prison in 2010 after he pleaded no contest to seventh-, eighth- or ninth-offense operating while under the influence in Grant County.

Fagan was sentenced to two years in prison and two years extended supervision in 2005, after he pleaded no contest to fifth-offense operating while intoxicated in Marathon County. Fagan was released on $10,000 bond Dec. 2, according to court records. 

He was ordered not to drive or possess or consume alcoholic beverages.
