MONROE — A Lafayette County jury last week convicted a Shullsburg man of homicide by intoxicated use of a vehicle following the traffic-crash death of an Amish buggy driver on July 23, 2021.
According to court records, the driver, Terry Allen Gensler, 50, faces a sentencing hearing at 2 p.m. April 3 before Circuit Judge James P. Daley.
The victim, Elmer K. Stoltzfus, 22, Gratiot, was airlifted to a Madison hospital but died the next morning due to his extensive injuries, Lafayette County officials said. The crash also injured Stoltzfus’ 2-year-old brother, who survived.
The accident occurred at about 7:15 p.m. on Wis. 11 just west of Gratiot. Gensler, the driver of a 2017 Dodge pickup truck, was uninjured. Stoltzfus was westbound in an open-style buggy and about to turn left into the driveway at 11263 Wis. 11 when Gensler’s truck hit the buggy from behind. That impact threw Stoltzfus and his brother from the buggy and killed the horse pulling their buggy.
The homicide by intoxicated use of a vehicle charge in Wisconsin carries a maximum prison term of 25 years. A pre-sentencing report also was ordered for Gensler, who was released on bond pending his sentencing.
Gensler was initially arrested on a first-offense charge of operating while intoxicated causing injury. But after Stoltzfus died, his charge was upgraded to felony homicide by intoxicated use of a vehicle.
