City: Forum can't recoup '08 tax

MONROE - Forum, Inc., a non-profit organization organized as a benevolent association, was denied a claim Wednesday seeking $1,251.36 for recovery of the first half installment of 2008 real estate tax paid on the StateLine Ice and Community Expo building.

Attorney Gregory E. Knoke filed the claim for Forum, Inc., citing Wisconsin state statute 74.33 (1) (c), that the taxation was enforced in error.

The City of Monroe Common Council voted 9-0 to deny the claim, on the advice of City Attorney Rex Ewald.

During a Claims Committee meeting, Ewald maintained Forum, Inc. was organized under state statues as a benevolent association and receives a 94 percent tax exemption as calculated when they began.

The organization is not organized under the state statue designed for youth hockey associations to receive a 100 percent tax exemption.

Forum owes back taxes from 2004 to 2007 in the amount of about $14,000. Another $5,000 is owed for interest and fees, which the county could waive, according to Green County Clerk Mike Doyle.

Forum paid property taxes from 2000 to 2003.

Until the organization reorganizes as a youth hockey association, Ewald said, the tax stays in effect.

"Taxation is the rule," Ewald said.
