DARLINGTON — An Argyle woman was sentenced Jan. 23 to five years in prison and three years extended supervision for the death of a 72-year-old Iowa County dairy farmer killed in a head-on crash in 2017.
Mary E. Bernet, 36, already began serving her sentence in November after pleading guilty to the Class D felony charge of homicide by intoxicated use of a vehicle. At her plea hearing Nov. 8, she requested through her attorney Guy Taylor that her bond be revoked and that she be able to begin her sentence right away.
The case stems from a traffic crash on Wisconsin 78, Town of Argyle, on Aug. 26, 2017.
Patrick B. Calhoun, 72, of rural Dodgeville, died at the scene. An investigation found Bernet’s pickup truck crossed the centerline at about 1:30 p.m. and hit the driver’s side of Calhoun’s oncoming 2017 Chevrolet Silverado pickup truck.
Court records indicate Bernet had a blood-alcohol content of 0.14 percent after the crash, nearly twice the legal limit for driving in Wisconsin. Police reported finding Keystone beer in the road and more beer in Bernet’s 2007 Dodge Dakota pickup truck, including a still-cold 12-pack of 16 oz. cans with eight left in the pack.
At Bernet’s sentencing, District Attorney Jenna Gill presented dozens of victim-impact statements to the court from Calhoun’s family, friends, neighbors and others who knew him. Gill said her office counted letters from at least 70 people, with letters still trickling in on the day of sentencing.
Three of the victims also addressed the court at the hearing.
Calhoun was a lifelong dairy farmer remembered for his “gentle spirit” and an Army veteran who served in Germany and Korea, according to his obituary. He is survived by his wife, Carol, two daughters and three grandchildren.
State court records show no prior criminal history or OWI convictions for Bernet in Wisconsin. She is ordered to undergo alcohol counseling or treatment and owes more than $4,500 in restitution and court fees.
