MONROE - Casey Shelton, convicted earlier this month of killing his 2-month old son in 2007, had a second trial on charges he abused his other twin son delayed Friday.
Shelton, 32, of Brodhead, was scheduled to begin a three-day trial Feb. 4 in connection to injuries to his son Charles in 2007. But the trial was postponed when his attorney withdrew from the case.
Shelton is charged with two counts of child abuse, one a class G felony and the other a class H felony. He faces up to 16 years in prison and up to $25,000, if convicted.
On Jan. 17, Shelton was found guilty by a jury of first-degree reckless homicide in the death of his son, Christopher, on Feb. 28, 2007 in Decatur township. He will be sentenced March 18.
In Green County Circuit Court Friday, Shelton's attorney, Michael Murphy, requested he be allowed to withdraw from the case. He said Shelton has made comments to third parties which have been critical of Murphy's abilities as a defense attorney. Murphy said it has become clear Shelton doesn't trust him.
"I don't feel that I can go forward as his attorney," Murphy told the court.
Green County Assistant District Attorney Jeff Kohl didn't dispute Murphy's request. Kohl said he understood Shelton's comments had put Murphy in a difficult situation and wouldn't allow him to provide adequate representation in court.
Shelton's attorney said he plans to contact the Wisconsin Public Defenders office in Monroe to arrange for Shelton to get an attorney. No time was set as to when Shelton will get another attorney.
