Judge says school must turn over records

DARLINGTON - The state is in the process of collecting medical, behavioral and other official records about two Argyle brothers accused of conspiring in an arson plot that killed three young boys and seriously burned their mother.

A judge ordered the Argyle School District this week to turn over to the state the behavioral records of Jeremy L. Wand, an 18-year-old senior at the high school. He and his brother Armin G. Wand III, 32, are being held on bonds of more than $1 million each for multiple counts of first-degree intentional homicide related to a house fire they allegedly set Sept. 7 on Oak Street in Argyle.

The order Tuesday, Oct. 2, for the school to produce behavioral records for the younger Wand follows an earlier subpoena for "all school records."

An attorney representing the school district agreed to release Jeremy Wand's attendance and progress reports but argued behavioral records are exempt since, at 18, he is no longer a minor. Judge William Johnston denied the motion.

The state is also seeking records related to both brothers from Monroe Clinic and Lafayette County Human Services.

The Wands next appear in court for a hearing at 10 a.m. Tuesday, Oct. 16.

Their joint preliminary hearing is scheduled Nov. 13.
