JUDICIARY AND ORDINANCE REVIEW COMMITTEE 1. Hold Public Hearing - Ordinance Repealing and Recreating Subsection 9-2-8 of the Monroe City Code: Animals at Large Public hearing opened up. Melissa Even -1015 23rd Ave - concerns with the proposed language changes for the ordinance regarding animal control. Physical restraint of an animal is very important, especially in public. She has concerns of escalated events and references a dog attack that occurred in the community earlier in the day. Sarah Ragan - 2120 11th St - also in favor of having physical restraint of a dog for public safety. She expresses fear for her children's safety and individuals with phobias related to dogs. She has a preference to proceed with the physical leash restraint regulations. Johnathan Ragan - 2120 11th St - resident in favor of having physical restraint for animal control, specifically with a leash. He has experienced dog attacks in his own neighborhood. There is a fear for public safety and individuals that have a fear of dogs if physical restraint is not required. LuAnne Radke - 2121 11th St - also witnessed dog attacks by unrestrained dogs in the community as well. Advises it would be reactive, not proactive, to allow dog control without physical restraint. She is not agreeable to allow verbal control for animals at large. She also witnessed the neighborhood dog attack earlier in the day. City Clerk Rindy reads a letter provided by Main Street Monroe that urges the Council to consider physical restraint in public areas, also expressing a concern for public safety. Public hearing closed. Attorney Bartholf provided a summary of the procedural route followed that led to today's discussion and consideration. Discussion that the current ordinance states an animals shall be controlled by a leash of six feet or otherwise under control. Staff attempted to further clarify what methods of control are acceptable and that the six foot distance is required no matter the method of control. Motion made by Andrew Kranig and seconded by Tom Miller to return the consideration of the ordinance repealing and recreating subsection 9-2-8 of the Monroe City Code: Animals at Large to Judiciary and Ordinance for further review and discussion. It is confirmed by city staff that there is a four-year agriculture lease for the land that is bid out. Alder Binger commends the great addition of the splash pad to the community and residents, as his family has spent some time there and greatly enjoyed it. N. BUSINESS PRESENTED BY DEPARTMENT HEADS City Clerk Rindy reminds the Council the next scheduled meeting will be on Tuesday, July 5, 2022 as the first Monday falls on Independence Day. O. BUSINESS PRESENTED BY THE PRESS None. P. COUNCIL OF THE WHOLE 1. Final 2021 Audit Report by Baker Tilly John Rader with Baker Tilly presents the City of Monroe 2021 Audit. He summarizes the various stages of the audit that begins in late fall of 2021, through the issuance of final reports in June 2022. He commends the city staff and Bauman Associates for their work to prepare for a successful audit. Internal control matters are addressed, the one item has been standing as long as Baker Tilly has been auditing the City of Monroe and is common for all municipalities. Most municipalities do not have the time or resources to prepare financial statements. It is a standard to report that as a control item. There are no material entries for the City of Monroe this year, which is not common and very commendable. Baker Tilly has been adjusting annual for outstanding clean water funds within the Waste Water fund restricted cash accounts. This could be a process the city could do as part of year end, rather than the auditors. John reviewed the financial highlights of the 2021 final audit provided with the agenda. There is a focus on the fund balance, debt policy, and utility financials. No questions were had by the Alders. Alder Bauman and Mayor Douglas comment on the great presentation of the audit by Baker Tilly and the great improvements the city staff, along with Bauman Associates, have made in handling financials over the years. 2. Compliance Maintenance Annual Report Utility Supervisor Kennison summarizes the purpose and history behind the Compliance Maintenance Annual Report (CMAR) that is submitted to the DNR annually. The City of Monroe received all "A's", with the exception of the phosphorus and ammonia categories. There have been extremely heavy loadings. The ammonia was potentially self-inflicted while trying to compensate for the heavy discharge of phosphorus from the wet industries. The staff is investigating where the heavy discharge of phosphorus is coming from and considering ways to meet current and future demands while staying within the required DNR levels. The waste water treatment facility (WWTF) is currently under a facility study as well to determine if changes to the facility are necessary. Thus far in 2022 there continue to be difficulties to remain below the required limits of phosphorus. The industries that discharge more phosphorus do pay more, however, that doesn't decrease the levels. There is an investigation into those specific industries and if they can pre-treat and reduce the levels discharged to the City of Monroe. The City of Monroe WWTF treats discharge in the amount of a typical population of 90,000, due to the heavy discharge from the industries. If the WWTF were expanded and increase the capacity, the DNR limit on phosphorus would also increase. Questions answered regarding the testing procedures and regulations. Corporate Resolution for UBS Financial Services City Clerk/Treasurer Rindy summarizes this UBS Financial Services is a procedural resolution updating the city staff authorized as signers and approvers for payments from the State funded Length of Service Award (LOSA) program for the fire fighters. Motion made by Joshua Binger and seconded by Andrew Kranig to approve the Corporate Resolution for UBS financial services. On a roll call vote, Motion Passed. 4. Update on City-Wide Property Maintenance Code Enforcement Program City Administrator Lothspeich summarizes the code enforcement program success and goal for compliance. There has been a total of seven citations issued. Anticipating an increase in citations in the near future for any property owners that have not taken any action. A few months back there was discussion regarding a potential demolition of an abandoned property. Currently staff is in communication with a developer and hopeful that the developer will proceed and the city will not be responsible for the demolition of the building. Reviewed the timeline anticipated to be followed after a citation is issued, understanding it is approximately 30 days before going to circuit court.’ Discussion held that if hardship is claimed by the resident, the grace period may be adjusted. Currently any properties issued a citation have been within the notification process for six months or greater, with zero response from the property owners. 5. Monthly Review of 1. Temporary Amendment to Employee Paid Time Off Policy 2. City of Monroe Public Health Emergency Personnel and Leave Policy Alder Bauman discussed at a prior Council meeting there was a recommendation to review the full employee paid time off policy. City staff is working to investigate and present this to Salary and Personnel in the next month. It is recommended not to take any action until Salary and Personnel reviews. 6. BUSINESS: CLOSED a.
