Town of Cadiz Notice of Revision of Ordinance 05.030

Notice is hereby given that on October 18, 2023 the following ordinance was amended by the Town Board of the Town of Cadiz:

Driveway Permit Ordinance

The Town Board of the Town of Cadiz pursuant to its authority under § 60.22(3). § 61.23(1) and § 236.45 Wis. Stats. does hereby revise the Town of Cadiz, Driveway Permit Ordinance and does ordain as follows: Section 3, Purpose. The description has been changed to add the following wording to explain the need for the ordinance: Driveways that are not constructed according to the specification in this ordinance may cause damage to the road, the right of way, or to the banks. Section 4, Definition. The description has been changed to clarify the definitions of types of driveways and other definitions: Types of driveways: a. Residential driveway. A residential driveway leads first to a residence. b. Field driveways. A field driveway allows a farmer access to a field by tillage, harvesting and other agricultural equipment. c. Joint driveways. A joint driveway provides access to more than one residence. d. Commercial driveway. All other driveways will be considered commercial driveways, including driveways which lead first to farm buildings. Other definitions: A. Joint driveway agreement. A joint driveway agreement establishes the proposed joint driveway and the manner of its construction, maintenance, and use. This agreement is required for all joint driveways. B. In-back-out. In-back-out refers to the radius required for a vehicle to pull into the driveway and then back out onto the road. Section 5, General Provisions. Sub-section C has been amended to emphasize the issue of a field driveway being converted to a residential driveway by making it separate a sub-section (D). Subsection E and F have been amended to move them to section 6, Permit Fees. Subsections G and E have been renumbered. C. No building permit for new residential construction will be issued until the driveway is constructed according to the specifications of this ordinance. D. If a field driveway is converted to a residential driveway, it will require a driveway permit and it must be brought to code and be approved by the Town Board. Section 9, Specifications for Construction of Joint Driveway. Permit fees have been moved to section 6, permit fees. Subsection A has been amended to better define specifications. A. Any shared portion driveway must be brought up to joint driveway specifications. • Minimum twenty (20) foot roadway • Minimum twenty (20) foot culvert • End caps on either side of the culvert. • Maximum ten percent (10%) grade without an engineer’s plan. Section 11, Existing Driveways and Field Roads. Sub-section A has been added to emphasize that updates to an existing driveway require that it be brought up to code. A. Existing driveways shall be brought up to code when there are updates to the driveway. Section 13, Penalties. Section 13 has been amended to further explain penalties for not complying with the requirements for driveways. If the fee has been waived for a field driveway, and the driveway is not constructed according to the specifications contained in this document, the owner of the land shall be liable for the fee, in addition to the penalties. C. The owner of the land through which the driveway passes shall be liable for any damages to the road due to illegal driveways or to construction damage. D. Any unpaid fees or penalties shall be added to the owner’s property tax bill as a special charge. This ordinance became effective on November 29, 2023.
