NOTICE OF REFERENDUM ELECTION COUNTY OF GREEN November 6, 2018

COUNTY OF GREEN REFERENDUM

NOTICE IS HEREBY GIVEN, that at an election to be held in the County of Green, on Tuesday, November 6, 2018, the following Resolution of the County Board will be submitted to a vote of the people:

RESOLUTION 8-3-18 Resolution Authorizing a Referendum to Exceed State Imposed Tax Levy Limits in 2019 through 2024 for the Benefit of Pleasant View Nursing Home

WHEREAS, the Green County Board of Supervisors does proclaim its continuing support for county ownership and operation of Pleasant View Nursing Home for so long as it is practical for the county to do so; and WHEREAS, the State of Wisconsin has imposed limits on town, village, city and county property tax levies for 2019 under Section 66.0602 of the Wisconsin Statutes; and WHEREAS, Section 66.0602 of the Wisconsin Statutes limits the increase to local property tax levy to the increase in net new construction; and WHEREAS, the current state budget allows an increase in the 2019 tax levy of .557% ($72,502); and WHEREAS, the Finance and Accounting Committee and the Pleasant View Nursing Home Committee have determined that it may be necessary to levy up to an additional $790,000 above the levy limit for each of the next six years for the financial well-being and stability of Pleasant View Nursing Home; and WHEREAS, Section 66.0602(4) of the Wisconsin Statutes allows a political subdivision to exceed the levy limit if the governing body adopts a resolution to that effect and if the resolution is approved in a referendum vote of the electors of the political subdivision; and WHEREAS, the Finance and Accounting Committee and the Pleasant View Nursing Home Committee have determined that it is desirable and in the best interest of Green County to conduct a county-wide referendum to determine whether the Green County taxpayers support the county exceeding the levy limit under Section 66.0602 of the Wisconsin Statutes, or any successor thereto, for the next six fiscal years, in recognition that Section 66.0602 of the Wisconsin Statutes may be amended or renewed in the future. NOW, THEREFORE, BE IT RESOLVED, that the Green County Board of Supervisors, in legal session assembled, does hereby approve that the following question be placed on the November 6, 2018 General Election ballot as a binding referendum question: Under state law, the increase in the levy of the County of Green for the tax to be imposed for the next fiscal year, 2019, is limited to .557%, which results in a levy of $13,092,171. Shall the County of Green be allowed to exceed this limit and increase the levy for the next six fiscal years, 2019 - 2024, for the exclusive purpose of paying for a portion of the cost of the operational and capital expenses of the county-owned Pleasant View Nursing Home, by a total of 6.625%, which amounts to a levy increase of $790,000 per year, which results in a total county levy of $13,882,171? YES _____ NO _____ BE IT FURTHER RESOLVED that the Green County Board of Supervisors supports an increase in the county tax levy to exceed the state levy limit for the next six years, 2019 through 2024 up to $790,000 per year. EXPLANATION

The November 6, 2018, general election ballot asks the county electors to vote “yes” or “no” on the referendum question above. A “yes” vote on the question is a vote in favor of authorizing the County of Green to exceed the tax levy limit imposed under s. 66.0602, Wisconsin Statutes, by an amount between $0 to $790,000 for fiscal years 2019, 2020, 2021, 2022, 2023 and 2024. A “no” vote on the question is a vote against authorizing the County of Green to exceed the tax levy limit imposed under s. 66.0602, Wisconsin Statutes, by an amount between $0 to $790,000 for fiscal years 2019, 2020, 2021, 2022, 2023 and 2024. In the event a majority of the electors vote “yes” to the question, the County of Green would be authorized to exceed the tax levy limit imposed under s. 66.0602, Wisconsin Statutes, by an amount between $0 to $790,000 for fiscal years 2019, 2020, 2021, 2022, 2023 and 2024. Any amounts levied under the authority of this referendum must be used exclusively for the purpose of operating Pleasant View Nursing Home. In the event a majority of the electors vote “no” to the question, the County of Green would not be authorized to exceed the tax levy limit imposed under s. 66.0602, Wisconsin Statutes, by an amount between $0 to $790,000 for fiscal years 2020, 2021, 2022, 2023 and 2024. Necessary expenses incurred in the operation of Pleasant View Nursing Home may have to be appropriated from other county funds or from other county departments. CITY OF MONROE COMMON COUNCIL MINUTES

CALL TO ORDER The Common Council was called to order on October 15, 2018. A. PLEDGE OF ALLEGIANCE B. ROLL CALL Present at roll call were Alders Michael Boyce, Brooke Bauman, Chris Beer, Jeff Newcomer, Richard Thoman, Ron Marsh, Donna Douglas, and Mickey Beam. Alder Rob Schilt was absent. C. CORRECTION OF MINUTES None. D. BUSINESS BY MAYOR 1. Consideration of sanitary sewer leak adjustment for leak at 1312 16th Avenue Mayor Armstrong explained that the Board of Public Works approved splitting the cost of the leak overage with the customer. Mayor Armstrong asked the Council to reconsider the decision that was made. Motion made by Michael Boyce and seconded by Ron Marsh to reverse the BPW decision to split the overage cost. On a roll call vote, Motion Passed. E. APPEARANCES BY THE PUBLIC Brian Saugstad of 2414 8th Ave addressed the Council with opposition on the recommendation to not fill the Parks Supervisor position, stating it will affect the workings of the department along with two other departments, public works and recreation. COMMENTS/QUESTIONS ON TREASURER'S REPORT (2ND REGULAR MEETING OF EACH MONTH) 1. Treasurer's Report No comments or questions. H. JUDICIARY AND ORDINANCE REVIEW COMMITTEE 1. Consideration of zoning changes to reflect current land use, which may be considered down zoning in some cases (Hold public hearing) A public hearing was held. 1.Fred Kundert addressed the Common Council. He stated that he is representing his mother regarding the subdivision on south side of Monroe (Alpine Acres). He explained that on April 3, 2002, the subdivision was submitted, and on April 11, 2002, was approved as a PUD. The property owner wishes to keep the property zoned as PUD. 2. Neal Trickel of 1911 10th Street explained that his property must remain zoned as commercial due to his federal firearms dealer license. 3. Carol Stamm, realtor with Hedeman First Weber, addressed the Council on behalf of her client who is the property owner of 1817 10th Street. The property is currently being marketed as a mixed use, and the property owner would like the property to be zoned as a mixed use as to not limit the options for potential buyers. 4. Will Springer of Brennan Steil S.C. out of Janesville, WI, was present to represent his client, William H. Larson, property owner of the Cedar Green, Monroe Village, and Monroe Terrace apartments. He shared several concerns he had about verbiage in the code relating to non-confirming structures and uses, parking requirements, and density requirements, and explained that the property owners would like the zoning to remain as is. He further explained that the minimum lot area per unit is 3,000 square feet for MR-15, while the MR-30 has a minimum lot area of 1,500 square feet per unit. He asked that Cedar Green be rezoned MR-30. 5. Craig Fuchs of 1815 2nd Ave is the controller for Orchid International, located at 350 21st Street. Currently, the property is zoned as heavy industrial. Orchid would like the zoning for parcel numbers 2325123540102 and 2325123530000 to stay as heavy industrial, due to the manufacturing of steel and noise and vibrations from the manufacturing. 6. Grant Bibby - CEO and co/owner of Orchid, reiterated importance of remaining zoned as heavy industrial. 7. Robert Duxstad, owner of the property located at 911 19th Ave, proposed a change to the TR-10 zoning district for a a conditional use allowing a 3 or 4 unit dwelling, as it would provide more flexibility going forward. Duxstad urges that the area be expanded for more Central Mixed Use, as the proposed zoning limits options for the City. Jackie Mich of Vandewalle and Associates spoke and explained that the ordinance rewrite has been a long, thorough process. She addressed non conforming uses and explained that they will remain non conforming, but a non conforming structure or lot is grandfathered in unless there are major changes made to the site, like major additions. She further explained that the new code is intended to be easier to use by other City staff or people who have had no experience with the code. 2. Ordinance repealing and recreating section 8-3-6 of the Monroe City Code: Issuance of Solid Waste Hauler Licenses (Hold public hearing) A public hearing was held. No one from the public spoke. Motion made by Chris Beer and seconded by Ron Marsh to approve the ordinance repealing and recreating section 8-3-6 of the Monroe City Code: Issuance of Solid Waste Hauler Licenses. Ordinance repealing and recreating section 9-2-2 of the Monroe City Code: Issuance of Animal Control Licenses and Permits (hold public hearing) A public hearing was held. Ron Marsh thanked the Police Chief for the Cheese Days report and asked the Administrator to look at the departments that are over budget. 1. Request to Release the Minutes from the Closed Sessions Related to the Hiring of the Position for Supervisor of Parks and Urban Forestry Agenda item was skipped due to lack of interest to release minutes due to open meeting law violations and the desire to maintain the purity of closed sessions. N. BUSINESS PRESENTED BY DEPARTMENT HEADS Administrator Rath advised that the budget and line item summary will be going out later that evening and that he is open to meet with anyone to talk through things if questions come up. O. BUSINESS PRESENTED BY THE PRESS Bridget Cooke of the Monroe Times requested clarification on why the agenda item was skipped. Mayor Armstrong explained it was skipped due to a lack of interest in violating open meeting laws and the desire to maintain the purity of closed sessions. P. Notice is hereby given that the Board of Review for the Town of Sylvester,Green County, Wisconsin, shall hold its first meeting on November 14, 2018, from 6:00 p.m. to 8 p.m., at Sylvester Town Hall, N4505 Hwy, 59, Albany, WI Please be advised of the following requirements to appear before the board of review and procedural requirements if appearing before the board: 1. No person will be allowed to appear before the board of review, to testify to the board by telephone, or to contest the amount of any assessment of real or personal property if the person has refused a reasonable written request by certified mail of the assessor to view the property. 2. After the first meeting of the board of review and before the board's final adjournment, no person who is scheduled to appear before the board of review may contact or provide information to a member of the board about the person's objection, except at a session of the board. 3. The board of review may not hear an objection to the amount or valuation of property unless, at least 48 hours before the board's first scheduled meeting, the objector provides to the board's clerk written or oral notice of an intent to file an objection, except that upon a showing of good cause and the submission of a written objection, the board shall waive that requirement during the first 2 hours of the board's first scheduled meeting, and the board may waive that requirement up to the end of the 5th day of the session or up to the end of the final day of the session if the session is less than 5 days with proof of extraordinary circumstances for failure to meet the 48-hour notice requirement and failure to appear before the board of review during the first 2 hours of the first scheduled meeting. 4. Objections to the amount or valuation of property shall first be made in writing and filed with the clerk of the board of review within the first 2 hours of the board's first scheduled meeting, except that, upon evidence of extraordinary circumstances, the board may waive that requirement up to the end of the 5th day of the session or up to the end of the final day of the session if the session is less than 5 days. The board may require objections to the amount or valuation of property to be submitted on forms approved by the Department of Revenue, and the board shall require that any forms include stated valuations of the property in question. Persons who own land and improvements to that land may object to the aggregate valuation of that land and improvements to that land, but no person who owns land and improvements to that land may object only to the valuation of that land or only to the valuation of improvements to that land. No person may be allowed in any action or proceedings to question the amount or valuation of property unless the written objection has been filed and that person in good faith presented evidence to the board in support of the objections and made full disclosure before the board, under oath, of all of that person's property liable to assessment in the district and the value of that property. The requirement that objections be in writing may be waived by express action of the board. 5. When appearing before the board of review, the objecting person shall specify in writing the person's estimate of the value of the land and of the improvements that are the subject of the person's objection and specify the information that the person used to arrive at that estimate. 6. No person may appear before the board of review, testify to the board by telephone, or object to a valuation if that valuation was made by the assessor or the objector using the income method of valuation, unless the person supplies the assessor with all the information about income and expenses, as specified in the assessor's manual under s. 73.03 (2a), Wis. stats., that the assessor requests. The Town of Sylvester has an ordinance for the confidentiality of information about income and expenses that is provided to the assessor under this paragraph that provides exceptions for persons using information in the discharge of duties imposed by law or the duties of their officer or by order of a court.* The information that is provided under this paragraph, unless a court determined that it is inaccurate, is not subject to the right of inspection and copying under s. 19.35 (1), Wis. stats. 7. The board shall hear upon oath, by telephone, all ill or disabled persons who present to the board a letter from a physician, surgeon, or osteopath that confirms their illness or disability. No other persons may testify by telephone unless the Board, in it’s discretion, has determined to grant a property owner’s or their representative’s request to testify under oath by telephone or written statement. 8. No person may appear before the board of review, testify to the board by telephone, or contest the amount of any assessment unless, at least 48 hours before the first meeting of the board, or at least 48 hours before the objection is heard if the objection is allowed under s.70.47 (3) (a), Wis. stats., that person provides to the clerk of the board of review notice as to whether the person will ask for the removal of a member of the board of review and, if so, which member, and provides a reasonable estimate of the length of time the hearing will take.
