PROCEEDINGS OF THE GREEN COUNTY BOARD OF SUPERVISORS October 19, 2021 County Boardroom, Green County Courthouse, 1016 16th Ave, Monroe, WI

Arthur Carter, Chair, called the meeting to order at 7:00 p.m. The Clerk read the roll call with 28 present and 3 absent being Maresch, Truttmann and Williams. The Board recited the Pledge of Allegiance. Motion by Rufenacht, seconded by Neuenschwander to approved the September 14, 2021, minutes. Motion carried by a unanimous voice vote. Motion by Thoman, seconded by Furgal to continue with the Emergency Proclamation until the next county board meeting. Motion carried by a unanimous voice vote. ORDINANCE 21-1001 Amendment to Zoning and Land Use Department Fees And Board of Adjustment Public Hearing Notice WHEREAS, the Green County Land Use and Zoning Committee has general supervision over administration of the County Zoning Code Regulations; and WHEREAS, after review of the Green County Code, the Green County Land Use and Zoning Committee has indicated that the Green County Code is in need of updating; and NOW, THEREFORE, BE IT ORDAINED by the Green County Board of Supervisors, in legal session assembled, that Title 4, Chapter 6 of the Green County Code be amended as follows: 4-6-1-4: FEES A fee shall be paid to the Zoning Department by each applicant at the time of the issuance of a permit and shall be remitted to the County Treasurer. Any fees which are remitted to the Zoning Department are not refundable for any reason. A. Zoning Permits shall be required for the following with the fees to be established by the Green County Land Use and Zoning Committee: 5. The above fees will be doubled whenever the project has been started prior to the issuance of the building and land use permit. The above fees will be tripled if the building and land use permit is not obtained within thirty (30) days of notification. If the violation is found after a new owner has purchased the property, the fee will not be doubled unless the new owner fails to obtain the building and land use permit within 30 days of notification. (Ord. 08-1002, 11/12/08) 4-6-1-5: BOARD OF ADJUSTMENT There shall be a Board of Adjustment comprised in accordance with section 1-7-22 of the Green County Code. The Board of Adjustment shall choose its own chairman. Vacancies shall be filled for the unexpired terms of any members whose terms become vacant in the same manner as the original appointment. The members of the Board of Adjustment shall be compensated at the same per diem and mileage rates as paid the County Board supervisors. A. Rules: 4. Notice of any public hearing which the Board of Adjustment is required to hold under the terms of this Title shall specify the date, time and place of hearing and the matters to come before the Board of Adjustment at such hearing, and such notice shall be given in each of the following ways: (1982 Code) a. RESOLUTION 10-1-21 Resolution Authorizing Acquisition of Approximately 0.46 Acres Located in the Town of Jordan WHEREAS, it has been determined by Jewell Associates Engineers, Inc., hired by the Green County Highway Department, that the Jordan Creek Bridge located on County Trunk Highway Y needs additional right of way to accommodate the maintenance of the drainage system on a portion of the highway designated above; and, WHEREAS, it is necessary to acquire certain lands as shown in the right of way plat which is made a part of this resolution by reference hereof; and, WHEREAS, to effect this change, pursuant to authority granted under Sections 83.07 & 83.08 Wis. Stats., the County of Green orders that: 1. The said road is laid out and established to the lines and widths shown on the aforementioned plat 2. The required lands or interests in lands as shown on the plat shall be acquired by the County of Green 3. RESOLUTION 10-2-21 Resolution Accepting FEMA Pre-Disaster Mitigation Assistance Grant and Authorizing the Acquisition and Demolition of Property Located in the Town of Cadiz WHEREAS, the State of Wisconsin Department of Military Affairs (DMA), Division of Emergency Management, administers the Federal Emergency Management Agency (FEMA) Pre-Disaster Mitigation Assistance Grant Program; and, WHEREAS, Green County Emergency Management applied for the Grant, and DMA and FEMA, relying on representations set forth in the Application, approved an award to the County in the amount of One Hundred and Twenty Thousand Dollars ($120,000) under grant # PDMC-PJ-05-WI-2019-0005; and, WHEREAS, upon acceptance, the Grant funds will be used to acquire property and demolish one flood prone residential structure in the floodplain in the Town of Cadiz; and, WHEREAS, the acquisition would consist of a parcel of land consisting of approximately 2.5 acres with a tax parcel number of 23-008.032.40000 and with an address of N216 N Bridge Street, Browntown, WI 53522, with a legal description as follows: Parcel I: Starting at the Southwest corner of Section Thirty-three (33), Town One (1) North, Range Six (6) East, running thence North along the West section line of said Section Thirty-three (33), a distance of 581feet to an iron stake marking the point of beginning; running thence N50°30'E, a distance of 297 feet to the West bank of the Pecatonica River, thence Northwesterly along said West bank a distance of 419.3 feet (measured by chord) to a point which is 540 feet North of the point of beginning; thence South 540 feet to the point of beginning, and being in the Southwest Quarter (SW1/4) if the Southwest Quarter (SW1/4) of Section Thirty-three (33), Town One (1) North, Range Six (6) East, being in the Town of Cadiz, Green County, Wisconsin. Parcel II: Also, Lot Six (6), Block Thirteen (13), in the Village of Martintown, Town of Cadiz, Green County, Wisconsin. and, WHEREAS, Section 59.06(1) and Section 59.52(6) of the Wisconsin Statutes allows the County Clerk to acquire, lease or rent property, real and personal, for public uses; and, NOW, THEREFORE, BE IT RESOLVED by the Green County Board of Supervisors, in legal session assembled, that the Green County Board approve the recommendation of the Green County Property Committee to accept the Grant in the amount of One Hundred and Twenty Thousand Dollars ($120,000) and authorize the acquisition and demolition of the above-described property; and, BE IT FURTHER RESOLVED that the County Board Chair is authorized to sign all documents required to accept the Grant, and complete the acquisition and demolition of one flood prone residential structure in the Town of Cadiz. RESOLUTION 10-3-21 Resolution Awarding County Clerk Contract in Excess of $75,000 WHEREAS, County Code Section 1-11-2, entitled COUNTY PURCHASES AND CONTRACTS, provides for review, approval and execution of all county contracts and purchases necessary to carry out approved budget operations; and WHEREAS, Section 1-11-2(A)(3) states: Cost or price in excess of seventy-five thousand dollars ($75,000.00), recommendation by the appropriate department head and the supervisory committee to the full County Board and approval by the full Board before the purchase is made.
