PROCEEDINGS OF THE GREEN COUNTY BOARD OF SUPERVISORS October 10, 2023 County Boardroom, Green County Courthouse, 1016 16th Ave, Monroe, WI

Chair Jerry Guth called the meeting to order at 7:00 p.m. The Clerk read the roll call with 29 present, 1 absent being Wilke and 1 tardy being Sass. The Board recited the Pledge of Allegiance. Motion by Carlson, seconded by Boll to approve the minutes of the September 12, 2023, meeting with a correction to the minutes as Harvey W. Kubly being excused at the September meeting. Motion carried by a unanimous voice vote.

ORDINANCE 23-1001 Ordinance Rezoning Parcel in Town of Jefferson

WHEREAS, the Green County Board of Supervisors has adopted the Green County Land Use and Zoning Ordinance; and WHEREAS, the Green County Land Use and Zoning Committee has been petitioned to rezone a certain parcel of land from industrial and agricultural to residential; and WHEREAS, the Green County Land Use and Zoning Committee held a public hearing on the Petition on August 14, 2023, and has taken into consideration all of the testimony heard at such public hearing; and WHEREAS, it is the recommendation of the Green County Land Use and Zoning Committee that the land area described below be rezoned from industrial and agricultural to residential. NOW, THEREFORE, BE IT ORDAINED by the Green County Board of Supervisors in legal session assembled, that the following described parcel of land be rezoned industrial and agricultural to residential, to-wit: A part of the Northwest Quarter (NW ¼) of the Northwest Quarter (NW ¼) of Section 27, Town 1 North, Range 8 East, Town of Jefferson, Green County, Wisconsin, described as follows: Beginning at the Northwest corner of Section 27, Town 1 North, Range 8 East, running thence East 278 feet along North Section line of said Section 27, thence South 470 feet to iron stake, thence West 278 feet to centerline of road, thence North along said center line and West line of said Section 27, 470 feet to point of beginning AND All that part of the Northwest Quarter (NW ¼) of the Northwest Quarter (NW ¼) of Section 27, Town 1 North, Range 8 East, Town of Jefferson, Green County, Wisconsin, described as follows: Commencing at a point on the West line of Section 27, Town 1 North, Range 8 East, 470 feet South of the Northwest corner of said Section 27, thence South along West line of said Section and centerline of road, a distance of 190 feet, thence East 198 feet to the iron stake, thence North 36.03’ East, 135.9 feet to iron stake, thence North 80 feet to iron stake, thence West 278 feet to the point of beginning. and BE IT FURTHER ORDAINED that this amendment shall not take effect until more than 40 days after the adoption of the Ordinance by the County Board unless the Town affected files a Resolution with the County Clerk approving the Ordinance, then said Ordinance shall become effective upon the filing of the Resolution of the Town approving the same with the County Clerk; and BE IT FURTHER ORDAINED that this Ordinance shall be published in the official newspaper of the County. ORDINANCE 23-1002 Repeal of Sections 8-1-14 and 8-1-15

WHEREAS, the Green County Land Use and Zoning Committee has general supervision over administration of the County Zoning Code Regulations; and WHEREAS, after review of the Green County Code, the Green County Land Use and Zoning Committee has indicated that the Green County Code is in need of updating to address duplicative sections; and NOW, THEREFORE, BE IT ORDAINED by the Green County Board of Supervisors, in legal session assembled, that Sections 8-1-14 and 8-1-15 of the Green County Code be repealed as is attached to this Ordinance. Ordinance 23-1003 Modification to Green County ANNUAL COUNTY VEHICLE REGISTRATION FEE Ordinance

WHEREAS, building and maintaining highways and bridges are essential to sustaining the quality of Wisconsin’s highway infrastructure, which is vital to the state, counties and municipalities to support commerce, tourism and the safe transportation of people and goods; and WHEREAS, the Green County property tax appropriation and other revenues have declined over the last 15 years while increases in the cost of materials needed to maintain the county highway maintenance goals and programs have more than doubled; and WHEREAS, Wisconsin Statutes §341.35 gives a county the authority to enact an ordinance imposing an annual flat registration fee on all motor vehicles registered in this state which are customarily kept in the county; and NOW, THEREFORE, BE IT ORDAINED by the Green County Board of Supervisors, in legal session assembled, that Section 1-11-12 of the Green County Code be modified as shown below, to be effective on January 1, 2024. 1-11-12-4: ANNUAL REGISTRATION FEE At the time a motor vehicle is first registered or at the time of registration renewal, the applicant shall pay a county vehicle registration fee of $30.00. This fee is in addition to other fees required by Ch. 341, Wis. Stats. The Wisconsin Department of Transportation (WisDOT) shall collect the fee. Use of funds generated by this registration fee shall be restricted to Highway Department maintenance expenses. 1-11-12-8: EFFECTIVE DATE AND SUNSET PROVISION This ordinance shall take effect on January 1, 2024, and shall sunset and lose any and all force and effect as of December 31, 2028, at 11:59 PM unless further action is taken by the County Board of Supervisors prior to that date to terminate or extend the fee imposed by this ordinance.
