CITY OF MONROE COMMON COUNCIL MINUTES

CALL TO ORDER FOR THIS MEETING The Common Council meeting was called to order on Monday, July 6, 2021 at 6:31 PM. A. PLEDGE OF ALLEGIANCE ROLL CALL Present at roll call were Alders Rob Driver, Brooke Bauman, Michael Boyce, Richard Thoman, Donna Douglas, Mickey Beam, Andrew Kranig, and Bryan Doyle. Absent was Alder Joshua Binger. B. APPROVAL OF MINUTES - JUNE 21, 2021 Motion made by Donna Douglas and seconded by Rob Driver to approve the June 21, 2021 minutes. On a roll call vote, Motion Passed. C. PRESENTATIONS OF PETITIONS AND COMMUNICATION None. D. BUSINESS BY MAYOR None. E. APPEARANCES BY THE PUBLIC 1. Suzann Holland - 1512 13th Ave - Fire Chief Smits introduced Suzanne for her efforts to fundraise for oxygen masks for animals. She presented the masks she ordered, and thanked the Chief and donors. 2. Jeanette Kelty - 2921 13th Street - spoke on behalf of freedom of speech. She inquires if there is an ordinance or State Statute related to the freedom of speech or 1st Amendment. She has a concern with a sign at a neighboring home that has a large political sign and flag at his residence. In her research she notes that obscenity and hate speech are not protected by the 1st Amendment. F. CONSENT AGENDA 1. Claims List 2. Resolution Approving Special Events - 1. FAITH Addiction Awareness 5K Run 2. Monroe Bible Church Service and Picnic 3. Badger Trail Races Ultramarathon Run Motion made by Brooke Bauman and seconded by Richard Thoman to approve the Special Event resolution. On a roll call vote, Motion Passed. 2. Resolution Approving Removal of No Parking Zone on the 900 block of 16th Street Chief Kelley reviewed there was a prior tenant at this location that asked for the current parking restriction. The tenant has since moved, and the property owner is now asking for it to be removed. Motion made by Brooke Bauman and seconded by Richard Thoman to approve the resolution for the removal of the "no parking zone" on the 900 block of 16th Street. On a roll call vote, Motion Passed. H. LICENSE COMMITTEE 1. Resolution Approving the Renewal for "Class A" License for Julie's Bridal Gallery Motion made by Donna Douglas and seconded by Rob Driver to approve the resolution for the "Class A" license for Julie's Bridal Gallery. On a roll call vote, Motion Passed. 2. Resolution Approving Temporary Amendment to License Premises for "Class B" License to Add Outdoor Beer Garden for Leisure Lanes Motion made by Donna Douglas and seconded by Rob Driver to approve the resolution for the temporary amendment to the license premises for "Class B" license to add an outdoor beer garden for Leisure Lanes. On a roll call vote, Motion Passed. 3. Resolution Approving Temporary Class "B" License and Beer Garden Application from American Legion Post #84 in Conjunction with the 2021 Green County Fair Motion made by Donna Douglas and seconded by Mickey Beam to approve the Temporary Class "B" license and beer garden application for American Legion Post #84 in conjunction with the 2021 Green County Fair. On a roll call vote, Motion Passed. Abstained: Donna Douglas I. FINANCE AND TAXATION COMMITTEE 1. Propose to Establish a New TIF District and Proposed Redevelopment Agreement with Project Peak City Administrator Lothspeich advises direction is being sought by the Common Council tonight regarding the "Project Peak" Monroe Truck development and proposed new TIF district. The Finance and Taxation committee has recommended to proceed. Ehler's is on the line to also help answer questions and review. Alder Boyce reviews the proposed TIF will be pay as you go, indicating the incentive is paid out from the tax increment that will be collected. The development agreement will include an incentive for labor force development that will be reported to the State of Wisconsin and City of Monroe. Penalties will be applied if the goals are not met. The general consensus of Finance is to proceed. Alder Boyce explained he requested to expand the map to increase the area for potential smaller businesses in the adjacent west side of town to also be eligible to participate in a similar request. Monroe is not the only community in competition for the expansion of this business. There is the reference of future expansion noted in the report, and the project plan will provide the city with the opportunity to assist with the expansion of Monroe Truck, but not commit to any dedicated funds. Monroe Truck indicates they plan to proceed with the development in the City of Monroe with this proposed project. The current agreement is at the threshold to keep the City of Monroe as their number one location. J. BUSINESS PRESENTED BY ALDERPERSONS Alder Boyce enjoyed patriotic displays in and out of the Twining Park over the holiday weekend. K. BUSINESS PRESENTED BY DEPARTMENT HEADS None. L. BUSINESS PRESENTED BY THE PRESS None. M. COUNCIL OF THE WHOLE 1. Resolution Approving Permit for Possession and Use of Fireworks - Green County Fair Motion made by Rob Driver and seconded by Andrew Kranig to approve the permit for possession and use of fireworks - Green County Fair. On a roll call vote, Motion Passed. 2. Resolution Accepting GovHR Job Classification and Total Compensation Review Proposal Alder Boyce inquires if the compensation study includes the police department. The study will include all departments. The Police negotiates their compensation with the union, and they just entered a three-year contract based on their own comparables. It is suggested to carve out the Police Department as those wages are recently updated based on up-to-date comparables. The Council members share their concern of finding comparable wages, as there are many different variables to consider. There is also concern of frustrations that can develop based on the study if the City cannot meet the comparable wages. Alder Boyce would rather see a staffing study than a compensation study, but overall does not have any objections. Administrator Lothspeich reviews there are valid points being made. There is difficulty attracting and retaining good employees. There will be risk with a study, but in his experience the value of evaluation is thorough and beneficial. The classification portion of the proposal would be the equivalent of a staffing study. There have been many changes with staff over the last few years, and the goal would be to help realign those duties and affirm the value of the wages. There are also some long term employees that are nearing retirement, this study will help with future planning for those transitions. This is a tool for the budget cycle and does not mandate any salary changes. Alder Boyce made a motion to amend the original motion to carve out the Police Department from the proposal, seconded by Alder Driver. Motion carried by voice vote. Alder Thoman reviewed the total compensation package was not included in the County study, and was difficult to compare as benefits were not included. This package does include total compensation (benefits). Alder Bauman and Alder Kranig share Alder Thoman's concerns regarding what will be done with the compensation study if the comparable wages can't be met. Alder Boyce explains this will be a benchmarking tool to identify issues to work on and develop a long-term plan. He believes the job classification will be beneficial for staff review and develop a long-term staffing goal. Alder Bauman believes the job classification review may be beneficial to have prior to the compensation study. Dave recommends he revisits the proposal with GovHR and return with an updated proposal based on the conversations held tonight. Alder Boyce clarifies he would like to keep the police classification in the proposal, but carve out the compensation portion. The Council can either make another motion to table this discussion, or vote the proposal down from the original motion made. Motion made by Rob Driver and seconded by Mickey Beam to approve the resolution accepting the GovHR job classification and total compensation review. On a roll call vote, Motion Failed. County Boardroom, Green County Courthouse, 1016 16th Ave, Monroe, WI Arthur Carter, Chair, called the meeting to order at 7:02 p.m. The Clerk read the roll call with 29 present and 2 absent being Borowski and Lonien. The Board recited the Pledge of Allegiance. Motion by Roth, seconded by Gundlach to approved the June 8, 2021, minutes as amended. Motion carried by a unanimous voice vote. Troy Maggied from the Southwestern Wisconsin Regional Planning Commission gave a presentation. Motion by Guth, seconded by Hanson to move the annual reports to be next on the agenda. Motion carried by a unanimous voice vote. Register of Deeds Cindi Meudt presented the Register of Deeds annual report. Motion by Furgal, seconded by Mandel to accept the report. Motion carried by a unanimous voice vote. Emergency Management Director Tanna McKeon presented the Emergency Management annual report. Sheriff Jeff Skatrud presented the Sheriff’s department annual report. Motion by Thoman, seconded by Leonard to accept the annual reports. Motion carried by a unanimous voice vote. There were public comments on Ordinance 21-0601 (Creating All-Terrain Vehicle and Utility-Terrain Vehicle Trail Crossings and Routes on County Trunk Highways in Green County). ORDINANCE 21-0601 Creating All-Terrain Vehicle and Utility-Terrain Vehicle Trail Crossings and Routes on County Trunk Highways in Green County WHEREAS, the Green County Highway Committee is charged with the duty to receive and make recommendations for Green County upon all highway matters referred to them; and WHEREAS, the Green County Highway Committee believes it is in the interest of Green County to open up certain county trunk highways for use by all-terrain vehicles (ATV) and utility-terrain vehicles (UTV); and WHERES, in order to accomplish this the State of Wisconsin requires the County Board of Supervisors to adopt an ordinance to create a route upon which ATV/UTVs may travel on certain designated county trunk highways; NOW, THEREFORE, BE IT ORDAINED by the Green County Board of Supervisors, in legal session assembled, that Title 8, Chapter 2 of the Green County Code be created as is attached to this Ordinance. Motion by Withee, seconded by Leonard to amend the ordinance to eliminate Sections 8-2-5: (B)7 and 8-2-6: (C). Motion failed with 10 ayes and 19 nays on a roll call vote with nays being: Blumer, Boll, Guth, Hanson, Hartwig, Hoesly, Krattiger, Kubly, Leonard, Mandel, Nelson, Neuenschwander, Olson, Roth, Rufenacht, Schwartz, Torkelson, Truttmann, and Williams. Motion by Hoesly, seconded by Rufenacht to amend the ordinance to modify section 8-2-9: (11) to read: All ATV and UTV operators are required to have the same liability insurance as the state requires for automobiles and carry proof of this insurance while operating on designated ATV/UTV routes. By utilizing any ATV/UTV route the operator agrees to fully indemnify and hold harmless Green County for all liability arising from use of ATV/UTVs on Green County Trunk Highways. Motion failed with 8 ayes and 21 nays on a roll call vote with nays being: Bernstein, Blumer, Boll, Furgal, Gundlach, Guth, Hartwig, Kubly, Leonard, Mandel, Maresch, Neuenschwander, Olson, Sass, Schwartz, Snow, Thoman, Torkelson, Truttmann, Williams, and Withee. Motion by Withee, seconded by Snow to amend the ordinance to modify section 8-2-9: (C)2 to read: ATV and UTVs may not be operated between the hours of 1 a.m. and 5 am. Motion failed with 10 ayes and 18 nays on a roll call vote with nays being: Boll, Carter, Furgal, Gundlach, Guth, Hanson, Hoesly, Krattiger, Kubly, Leonard, Mandel, Maresch, Neuenschwander, Olson, Roth, Rufenacht, Schwartz, and Truttmann. A vote for Nelson was not recorded. Motion carried to approve Ordinance 21-0601 by a roll call vote of 27 ayes and 2 nays being: Hoesly and Luchsinger. ORDINANCE 21-0701 Modification Regarding Job Postings WHEREAS, the Green County Personnel and Labor Relations Committee has general supervision over County personnel policies; and WHEREAS, after review of the Green County Code, the Green County Personnel and Labor Relations Committee has indicated that the Green County Code is in need of updating; and NOW, THEREFORE, BE IT ORDAINED by the Green County Board of Supervisors, in legal session assembled, that the following additions be made to Title 1 of the Green County Code. 1-9-3: JOB POSTING A. All job openings which are not filled from within the particular department are to be posted on the Green County website job link and on the Green County job board in all County facilities for a minimum of seven working days. All positions subject to this posting requirement may be simultaneously advertised for and filled from outside of the County employment system. In the case of For positions where equally qualified candidates apply, preference may be given to the County employee. This Section shall apply to all vacancies in existing positions within the County as well as for newly created positions. B. All departments, at their discretion, may maintain and keep an applicant’s application and/or resume in a job posting file for a maximum of 12 months. RESOLUTION 7-3-21 Resolution Authorizing IT Director to Make Application for Broadband Grants in Partnership with Hilbert Communications, LLC (Bug Tussel) and to Contract with Hilbert Communications, LLC for Assisting in the Grant Application Process WHEREAS, in order to address the substantial areas within Green County that are unserved or underserved with access to broadband internet, Green County recognizes a necessity to research and gather information to identify the broadband needs of its citizens and businesses, and to encourage providers to invest and provide those services in Green County; and WHEREAS, Hilbert Communications, LLC (“Hilbert”), and its subsidiary broadband wireless internet service provider company, Bug Tussel Wireless, LLC (“Bug Tussel”), have expressed a desire to commence a project consisting of the construction and operation of certain wireless communication services to provide the most advanced infrastructure to the unserved and underserved residents of Green County; and WHEREAS, Green County desires to pursue Broadband Expansion Grants offered by and through the State of Wisconsin Public Service Commission; and WHEREAS, Hilbert advises it is willing and able to partner with Green County to provide the latest advancements in broadband coverage and to seek all available grants to provide and subsidize the cost of necessary broadband infrastructure; and WHEREAS, the Green County Board of Supervisors previously adopted Resolution 11-01-19 authorizing a Memorandum of Understanding between Green County and Hilbert and authorizing a Broadband Expansion Grant Application to be jointly submitted to the State of Wisconsin Public Service Commission no later than December 19, 2019; and WHERAS, a Broadband Expansion Grant Application has not been jointly submitted to the State of Wisconsin Public Service Commission; and WHEREAS, Green County desires to pursue and make application for any and all grant money available for broadband coverage; and WHEREAS, the Finance and Accounting Committee have considered Hilbert and Bug Tussel’s history of community partnerships and their proposal to expand broadband to unserved and underserved areas of Green County and hereby recommend partnering with Hilbert to pursue broadband expansion grants. NOW, THEREFORE, BE IT RESOLVED, by the Green County Board of Supervisors, in legal session assembled, that the Board consider the recommendation of the Finance and Accounting Committee to authorize the IT Director to apply to the State of Wisconsin Public Service Commission for broadband expansion grants in partnership with Hilbert; and BE IT FURTHER RESOLVED, that the IT Director is authorized to negotiate with Hilbert to enter into development agreements for assistance in the grant application process, wherein there is no commitment for Green County spending money without further authorization of the Green County Board of Supervisors via resolution; and BE IT FURTHER RESOLVED, that the IT Director is authorized to do all such acts and to execute, acknowledge, and deliver all such documents necessary or desirable to fulfill the intent of this resolution; and BE IT FURTHER RESOLVED, that Resolution 11-01-19 is hereby rescinded and the Memorandum of Understanding attached to Resolution 11-01-19 as Exhibit A is hereby terminated. Motion by Thoman, seconded by Leonard to approve the following Sheriff’s Department travel request: Detective Curtis Erdmann to attend the Drug Endangered Children National Conference August 23-27, 2021, in Nashville, TN.
