CALL TO ORDER FOR THIS MEETING The Common Council meeting was called to order on Monday, March 15, 2021 at 6:30 PM. ROLL CALL Present at roll call were Alders Rob Driver, Donna Douglas, Brooke Bauman, Richard Thoman, Michael Boyce, Kelly Hermanson, Joshua Binger and Mickey Beam. Absent was Alder Tammy Fetterolf. A. APPROVAL OF MINUTES - MARCH 1, 2021 Motion made by Donna Douglas and seconded by Rob Driver to approve March 1, 2021 minutes. On a roll call vote, Motion Passed. B. Approve Resolution to Authorize Purchase of Motor Grader from Capital Reserve Funds Director of Public Works Al Gerber provided history surrounding the decision to purchase the proposed motor grader. Motion made by Brooke Bauman and seconded by Joshua Binger to approve the resolution to authorize purchase of motor grader from capital reserve funds. On a roll call vote, Motion Passed. H. PLAN COMMISSION 1. Review of Recommendation of Plan Commission for Town of Monroe / Town of Clarno's Zoning Map Amendment for property located at 840 W 8th Street, discussion, and Set Public Hearing April 5, 2021 Public hearing set for April 5, 2021. City Attorney Bartholf summarized the recommendation from Plan Commission for the zoning map amendment to change the current zoning of Suburban Mixed Use (SMU) to Neighborhood Mixed Use (NMU) and a zoning text amendment to allow "indoor institutional use" in the SMU zoning district. These are requests for the RFD property at 840 W. 8th Street, with the goal to allow for "indoor institutional uses" at their property. The zoning map amendment would allow for the "indoor institutional uses" at their property alone, versus the text amendment would change the city code allowing "indoor institutional uses" at all properties zoned SMU. Plan Commission made a recommendation to approve the zoning map amendment, then recommended the approval of the zoning text amendment subject to the failure of the zoning map amendment. If the Council approves the zoning map amendment, there will be the opportunity to vote on that immediately following the public hearing on April 5th. If that fails and the Council is in favor of approving the zoning text amendment, direction would be given to draft the ordinance for J&O to approve and return to Council for final approval on April 19, 2021. Alder Bauman reviews the letter sent to the RFD by the Building Inspector noted April 16, 2021 as the date fines would begin if they continued to operate as a Fire Department from the current property. She encourages consideration and necessary action to hold on any fines until after final action is taken on April 19th. Attorney Bartholf reviews if the zoning map amendment is approved, it is not necessary to approve the zoning text amendment. However, the Council could decide to approve both the zoning map amendment and zoning text amendment. Alder Thoman reviews the continued frustrations with this current situation. He would like to inquire why the RFD purchased the property prior to obtaining approval for the appropriate zoning. Now the City of Monroe is being coerced into changing the zoning code and comprehensive plan based on the action they took. The loss of the contract money and taxes would result in an increase of $700 to his personal taxes per year for a service outside of the City of Monroe. This is a difficult situation as it will either increase the tax burden for the City of Monroe residents, or result in being sabotaged by constituents for not allowing the RFD to have a fire department on that property. He wishes there would be more focus on the fact the RFD put themselves in this position with the decisions and actions they took. They are now forcing the Council into a difficult, no win situation. Attorney Bartholf clarifies if the requests are approved, the zoning would change. He further advises the precedent that could be set by continuously amending the city code any time a project does not fit within the current code. There was significant thought and purpose into the current city code that should be considered. If the zoning is not approved, and the RFD continues to own the property, it will remain tax exempt. If the RFD sells the property, it would then return to the productive tax pool. Alder Boyce reviews the information provided in the memorandum provided by Mike Slavney, zoning consultant with Vandewalle Associates. There are three requirements necessary for approval of the zoning map amendment. 1. Application complete 2. Zoning request is consistent with the comprehensive plan 3. Does it serve the public interest of the City of Monroe The first requirement has been met. The third requirement could be continually debated, so he would like to focus on the second requirement. Mike Slavney's memo explains the request for the NMU zoning district could be consistent with the comprehensive plan if the Plan Commission and Common Council think the area to the west and southwest would develop residentially. Currently there are no nearby residential neighborhoods to the parcel in question. When the future land use map was developed in 2015, the nearby parcels were under different ownership. They are now owned by Badger State Ethanol, so it is highly unlikely the parcels will be developed as residential. The Town of Monroe and Town of Clarno do not recognize the parcels as residential. Alder Boyce believes the zoning map amendment request is inconsistent with the City of Monroe's comprehensive plan as it is highly unlikely the parcels to the south and west would be developed as residential. The Plan Commission and Council are statutorily required to follow the comprehensive plan for guidance in this specific request. Alder Boyce further explains Mike Slavney advises if the parcels to the south and west will be pursued to be annexed into the City of Monroe for residential use, then it should be approved as it would be consistent with the comprehensive plan. If that is not the case and the proposal is deemed inconsistent with the comprehensive plan, State Statutes require denial. Alder Boyce would like to focus on the moral issue of the request and leave out the emotions. He does not believe the zoning map amendment is consistent with the comprehensive plan and therefore will not support the request. Alder Hermanson states Alder Thoman's discussion resonates with her concerns related to the zoning changes and she does not believe the zoning change would be good for the City of Monroe long term. 2. Review of Recommendation of Plan Commission for Town of Monroe / Town of Clarno's Zoning Ordinance Text Amendment to allow Indoor Institutional Land Uses in the SMU Zoning District, discussion, and Set Public Hearing - April 5, 2021 Public hearing set for April 5, 2021. I. PUBLIC SAFETY COMMITTEE 1. 2020 Annual Police Department Report Chief Kelley provided a high-level summary of the 2020 Annual Police Department report that was provided to the Council for review. He discussed the effects the COVID-19 pandemic had on the department. He also reviewed the statistics, with the year over year comparison. The statistics remain relatively stable and low in crime. J. BUSINESS PRESENTED BY ALDERPERSONS Alder Boyce reviewed the recent update provided by the City Administrator regarding prior thefts by former City employees. The District Attorney has this information and file on his desk but has not taken any action. Alder Boyce believes the Council would benefit from follow up discussion, and consideration of drafting a letter to the DA. Alder Beam expressed thanks to the downtown businesses that closed on Saturday, March 13th for their consideration of the safety of the citizens. Alder Douglas shares concerns of putting the priority on money before public safety. She encourages collaboration and intergovernmental support. K. BUSINESS PRESENTED BY DEPARTMENT HEADS None. L. Approve Resolution Allowing Temporary Use of Medical and Extraordinary Leave Banks for Employee Absences Related to COVID-19 Alder Thoman inquires specifics regarding what would qualify as "seeking COVID-19 diagnosis," and if employees could take advantage stating they frequently have symptoms. City Administrator Lothspeich advises in the prior policy, there has to be level of proof in regards to the symptoms or potential COVID-19 diagnosis to qualify, and that will continue to apply with this policy. Motion made by Rob Driver and seconded by Brooke Bauman to approve the resolution to allow temporary use of medical and extraordinary leave banks for employee absences related to COVID-19.
