CITY OF MONROE COMMON COUNCIL MINUTES

CALL TO ORDER FOR THIS MEETING The Common Council meeting was called to order on Monday, January 6, 2020. A. PLEDGE OF ALLEGIANCE ROLL CALL Present at roll call were Alders Rob Driver, Mickey Beam, Richard Thoman, Michael Boyce, Brooke Bauman, Donna Douglas, Joshua Binger and Tammy Fetterolf. Absent was Alder Kelly Hermanson. B. CORRECTION OF MINUTES None. C. PRESENTATIONS OF PETITIONS AND COMMUNICATION D. BUSINESS BY MAYOR Mayor Armstrong updated the Council on the current status of recruitment for the City Administrator. Ads have been placed with a few resumes submitted, and anticipation of more submissions following the holiday season. The deadline for submissions is February 7, 2020. The rural fire protection contract is active with negotiations. The Mayor notices redundancy in approving claims and plans to evaluate the process and make improvements through changes to the City code. Last summer during the County Fair there were issues with signs posted on the fencing that was never addressed. The Mayor will work with Judiciary and Ordinance to address that through the City Code in the upcoming year as well. E. APPEARANCES BY THE PUBLIC None. F. CONSENT AGENDA 1. Ordinance Repealing and Recreating Section 1-5-7 of the Monroe City Code: Common Council Meetings Order of Business (Hold Public Hearing) Opened for public hearing, no discussion held. Public hearing closed. Ordinance introduced by Alder Beam. Alder Bauman questioned if this is the only way that Alders may request an agenda item, however this is an additional option to the current processes in place. Alder Boyce questioned the reason for developing this ordinance. Mayor Armstrong answered that certain Alders have had concerns that items were not being addressed, and were seeking an alternative method to request agenda items when necessary. Motion made by Brooke Bauman and seconded by Joshua Binger to approve the Ordinance Repealing and Recreating Section 1-5-7 of the Monroe City Code: Common Council Meetings Order of Business. On a roll call vote, Motion Passed. Ayes: Bauman, Beam, Binger, Douglas, Driver, Fetterolf, Thoman Nays: Boyce H. FINANCE AND TAXATION COMMITTEE 1. Resolution Authorizing Public Works to Purchase Patrol Truck Richard Thoman shared there was discussion at the Finance and Taxation Committee meeting regarding if the replacement of the patrol truck is necessary, and measures will be taken to further evaluate the appropriate fleet size for future requests. Motion made by Richard Thoman and seconded by Michael Boyce to approve the resolution authorizing Public Works to purchase and the patrol truck. On a roll call vote, Motion Passed. I. LICENSE COMMITTEE 1. Resolution Approving Temporary Class "B" Wine and Fermented Malt Beverage License for Monroe Theatre Guild in Conjunction with Comedy Night 8 Motion made by Donna Douglas and seconded by Mickey Beam to approve resolution for temporary Class "B" wine and fermented beverage license for Monroe Theatre Guild in conjunction with Comedy Night 8. On a roll call vote, Motion Passed. J. COUNCIL OF THE WHOLE 1. Resolution Amending Salaries and Wage Rates for Full Time Permanent Dept Heads/Non Represented Personnel for 2020 Motion made by Brooke Bauman and seconded by Mickey Beam to approve the amended resolution for salaries and wage rates for full time permanent department heads/non-represented personnel for 2020. On a roll call vote, Motion Passed. 2. Fire Department Review Ad Hoc Committee Summary and Action to Close the Committee Alder Hermanson is absent tonight so Alder Bauman provided a summary of the Ad Hoc Fire Department Review Committee's findings and recommendations that were made. She reviewed the recommendations made, and are as follows: 1. Policy regarding the MVFF and Fire Department communication, with a recommendation to Salary and Personnel to update the internal communication policy to include outside organizations. 2. Each department head will update their respective organizational chart to include the names of employees currently in the particular position, as well as a discussion with the officers regarding promotions and vacancies of the officer positions that already exist. 3. Draft a successor agreement to the lease that expired in 2018 between the MVFF and City regarding leasing of the property. The drafted lease will be presented to Finance and Taxation for approval. 4. A donation policy will include larger items, money and standard procedure for where the money will be sent. The donation policy will be developed by Finance and Taxation. 5. A list of all items at the Merit Center and fire departments is being created and will be presented to Chief Smits. 6. Rob Jacobson, Director of Facilities and Logistics, will work with department heads to develop and updating policies regarding use of the city property. Included in this policy will be an item addressing storing personal property on city property and who determines who has access to the facilities. This will then be presented to council for final approval. 7. At an upcoming Officer meeting the chief and officers will discuss a preferred method of communication, with formal minutes to be distributed to all officers. 8. The Mayor will distribute the internal communication policy to all City employees. 9. Review of the Deputy Chief and Chief job descriptions. Based on the actions of the committee, it is recommended to close the committee. No motion is needed to close the committee, as providing the report closes the committee. The minutes with the listed recommendations will be sent to the Council as a whole by the City Clerk, Brittney Rindy. 3. Consideration and Potential Action Regarding 6 Month Extension of the Rural Fire Protection Services Agreement with the Town of Clarno and Town of Monroe Attorney Bartholf reviewed the history behind the contract negotiations with the Rural Fire District contract. The last contract was an agreement for 5 years that started in 2014. A year extension was granted to allow for renegotiation or to develop a new contract. In March 2019 the Finance and Taxation Committee met with the Rural Fire District members and presented the proposal to divvy out the fire department's budget, including capital and facilities based on equalized valuation of the properties that it protects and serves. The Rural Fire District did not respond to the proposal until late November. The City responded and was unable to work out a long term deal. A proposal was put forth to extend an offer on the same terms for six months, so it would match our budget. The goal is to then develop a longer term agreement that escalates the amount the townships have to pay based on equalization value. The amount would increase systematically over a time period of five years. Alder Boyce reviewed the purpose of having a five-year time period to increase the cost every year. The township has levy limit restraints that would need to be considered. If the township was asked to pay their equalized value right now, they would not be able to do so without exceeding their levy limits. The five-year window allows for flexibility and for the township to plan and raise their levy limits accordingly. It also allows the City time to reach out to other surrounding townships with the goal to expand the rural fire district. It was expressed that an agreement charging the townships on a per call basis would be unfair to the City of Monroe taxpayers. The current contract expires in June 30, 2020. There is not a set meeting date, however the goal is to meet again in late January to continue developing and negotiating the contract. The townships also have one week to present the contract extension to their boards for approval. Alder Douglas asks for more information why the change is necessary, and acknowledges this will present a hardship to the townships. Rebekah Rath, Youth in Government member, reviewed the cost has been counterproductive for the City of Monroe and therefore requires a new agreement. Alder Douglas would like to see the City continue to work with the townships, rather than forcing them to develop their own district. Alder Boyce reviewed the changes in agreements between the City and the Rural Fire District over time. He expresses that he does not want to give away services to the townships for less money than they cost the City of Monroe, as it is unfair to the City of Monroe taxpayers, who the Council represents. Alder Douglas requests that meetings be held with the townships to allow for negotiations and discussion, rather than forcing it upon the townships. She does not wish to see a breakdown between the entities. Alder Boyce shares the amount of money to be allocated to the different townships is approximately less than $70,000. The updated contract will be presented to Finance and Taxation and then to Council as a whole for final approval. Motion made by Brooke Bauman and seconded by Michael Boyce to approve the six-month extension of the Rural Fire Protection services agreement with the Town of Clarno and Town of Monroe. BUSINESS PRESENTED BY DEPARTMENT HEADS Brittney Rindy, City Clerk, shared an update regarding nomination packets that have been submitted for the upcoming spring election at the request of the Mayor. Currently Bill Ross and Mayor Armstrong have submitted papers to run for Mayor. Rob Driver, Richard Thoman, and Mickey Beam have submitted papers to run for Alderpersons. STATE OF WISCONSIN DEPARTMENT OF NATURAL RESOURCES PUBLIC NOTICE OF INTENT TO MODIFY WISCONSIN POLLUTANT DISCHARGE ELIMINATION SYSTEM (WPDES) PERMIT No.WI-0065773-01-1

Permittee: Pinnacle Dairy, LLC, 2670 D Road, Rising City, NE, 68658 Facility Where Discharge Occurs: Pinnacle Dairy, N4135 Decatur Sylvester Road, Brodhead, WI Receiving Water And Location: Surface water and groundwater within the Searles Creek within the Lower Middle Sugar River Watershed, and groundwaters of the state. Brief Facility Description : Pinnacle Dairy is an existing Concentrated Animal Feeding Operation (CAFO). Pinnacle Dairy is owned and operated by Pinnacle Dairy, LLC and Pinnacle Land Holdings, LLC. Pinnacle Dairy is operated by Tuls Dairies. The facility has 5,800 milking and dry cows and no replacement animals on site for a total of 8,294 animal units. Calves and heifers are raised off site at custom raiser facilities not associated with the farm. The farm has six sand bedded tunnel ventilated freestall barns, a milking parlor and holding area, one concrete lined waste storage facility, three high density polyethylene (HDPE) lined and covered waste storage facilities, sand settling lanes and storage area, manure solids separation building, office and weigh scale, and a feed storage complex which includes a feed storage slab, a leachate collection pond, a commodity shed and eight hay sheds. The site also includes one stormwater detention pond and a series of swales and culverts to handle stormwater flow on the site. Four approved monitoring wells will be placed around the farm site to monitor groundwater. The issued permit requires seven other monitoring wells around the four waste storage lagoons. Plans and specifications and installation of new wells are also required in the issued permit. Additional wells could be added at a later date. Pinnacle Dairy has installed two high capacity water supply wells along Decatur Sylvester Road to service the dairy facility. The Pinnacle Dairy Nutrient Management Plan (NMP) has been conditionally approved. There are 6,692.3 acres available for land application of manure and process wastewater. All of the acreage is under contract. This permit modification is necessary in order to update certain dates included in Pinnacle Dairy’s WPDES Permit after resolution of the contested case filed by the petitioners in DOA Case No. DNR-19-0002; In the Matter of Wisconsin Pollutant Discharge Elimination System Permit WI-0065773-01-0, Issued to Pinnacle Dairy, LLC.
